INSTRUCTION NO. 739/CBDT Dated : August 17, 1974 Section(s) Referred: 154 ,155 Statute: Income - Tax Act, 1961 Attention is invited to Board's Instruction No. 611 dated 7th September, 1973 whereby new forms of monthly returns of refund claims have been prescribed to ensure that all refunds arising out of appellate orders and rectification claims under section 154/155 are expeditiously attended to. To ensure that arrears of tax reduced by other adverse appeal/revision orders and rectification claims u/s 154/155 are also expedited, an additional statement to be serially numbered Part C in the enclosed proforma is now added thereto. This additional information may be furnished for the first time along with be September report due in October. 2. Now that the additional information regarding adverse appeal orders not directly resulting in refund has been called for as Part C of the report, the earlier requirements would clearly refer to cases of cash refunds either directly on assessment or subsequently in terms of rectification/appeal/revision orders. Therefore, it should be ensured that figures relatable to Part A and Part B of the earlier proforma strictly tally.
