SUBMISSION OF APPLICATIONS FOR CLAIMING DEEMED EXPORT BENEFITS UNDER PARA 8.3.1 OF HBP - VOL.1. - DGFT - 36 (RE-08)/2004-2009Extract SUBMISSION OF APPLICATIONS FOR CLAIMING DEEMED EXPORT BENEFITS UNDER PARA 8.3.1 OF HBP - VOL.1. POLICY CIR NO. 36 (RE-08)/2004-2009 DATED 16/10/2008 Attention is invited to Policy Circular No.17(RE-2008)/2004-09 dated 4th July, 2008 on the above subject. In Para 3 thereof, it is inter-alia mentioned that in respect of all the claims arising for a particular calendar month/quarter (as per option of the applicant), a single consolidated application should be filed within the stipulated period. 2. The matter has been considered and it has been decided that paragraph 3 of Policy circular No.17 dated 4th July 2008 may be substituted as under:- "3. The issues have been considered. It is seen that sub-para 8.3.1 (ii) and (iv) of Handbook Vol.I do not impose restriction on submission of multiple applications. However, to reduce the paper work and ensure proper monitoring, there is necessity to limit the number of applications which an applicant may file within a year. Therefore, it is clarified that in respect of all the claims arising for a particular month/ quarter (as per the option of applicant), one consolidated application should be filed within the stipulated time period. It is further clarified that for all the deemed export benefit claims, in respect of a particular project or a particular recipient (of goods) unit, arising in a calendar month/quarter (as per the option of applicant), a consolidated application can also be filed within the stipulated time period of twelve months from end of the monthly/quarterly period. Such applications, even if more than one in a month/quarter, will not be treated as supplementary claims under para 9.4 of HBP Vol.1." 3. It is also clarified that the cases filed prior to the issuance of Public Notice No.102 dated 16.1.2008 would be disposed of as per the provisions available prior to the above Public Notice.
