No. 20/2009) 1. Attention of Importers, Exporters, Customs Brokers and Trade is invited to the Public Notice No. 20/2009 dated 30.03.2009 issued from F. No. S/6-B-Misc-65/2009 CFS (M)(X) wherein the procedure was laid down to fulfill the working of BRC Module as envisaged in Board s Circular No. 05/2009-Cus. Dated 02.02.2009. 2. It has come to the notice that the concerned Exporters are not submitting Bank Realization Certificates (BRCs)/Negative Statements to the Deputy Commissioner of Customs (Export), Inland Container Depot, Mulund (East), Mumbai-400 081. 3. In pursuance of the CBEC s Instruction dated 27.11.15 issued vide F.No. 609/59/2012-DBK, all exporters are hereby advised to submit the certificates/negative statements issued by the competent authorities in respect of their drawback EDI shipping bills having LEO dates from 01.04.2013 to 31.03.2014. It is once again reiterated that all concerned are required to furnish the Bank Realisation Certificates (BRCs) to the Deputy Commissioner of Customs (Export), Inland Container Depot, Mulund (East), Mumbai-400 081 (Tel. No. 022-25636749) at the earliest to avoid initiation of recovery proceedings. Non- submission of above mentioned documents within one month s period shall attract action under Section 75 (1) of the Customs Act, 1962 read with Sub Rule 16 A (1) of the Customs, Central Excise Duties Service Tax Drawback Rules 1995 and the recovery of drawback amount will be made in terms of Rule 16 ibid.
