Compliance of Regulation 6 (3) HCCAR, 2009 - by all Service provider - Reg. - Customs - 145/2015Extract MINISTRY OF FINANCE DEPARTMENT OF REVENUE OFFICE OF THE COMMISSIONER OF CUSTOMS CHENNAI-VIII, CUSTOMS HOUSE 60, RAJAJI, SALAI, CHENNAI-600001 F.No.S.Misc.32/2011 ENQ. Date: 18-06-2015 PUBLIC NOTICE NO. 145/2015 Attention of Customs Cargo Service Providers is invited to the Regulation 2(b) of Handling of Cargo in Customs Areas Regulations, 2009 wherein it is defined that Customs Cargo Services provided' means any person responsible for receipt, storage, delivery, dispatch or otherwise handling of imported goods and export goods and includes a custodian as referred to in section 45 of the Act and persons as referred to in sub-section (2) of section 141 of the said Act; and as per Regulation 3, these regulations shall be applicable to the handling of imported and export goods in ports, airports, inland container depots, land customs stations and in customs areas approved or specified under section 8. All Customs Cargo Service Providers including Console Agents and Freight Forwarders, who operates in this jurisdiction are directed to submit their applications to the Commissioner of Customs Chennai-VIII, within 30 days from the date of issue of this Public Notice, to approve as Customs Cargo Service Provider. All Customs Cargo Service Providers including all Console Agents and Freight Forwarders are required to adhere to the Regulation 6(3) of Handling of Cargo in Customs Areas Regulations, 2009 and shall publish and display at prominent places including website or webpage of the Customs Cargo Service provider the schedule of charges for the various services provided by them in relation to the imported goods or export goods in the customs area lest they invite action under the said regulations under HCCAR, 2009. All Customs Cargo Service providers including Console Agents and Freight Forwarders shall therefore publish and display the schedule of charges for the various services provided by them, to clearly indicate the charges to be levied from Importers. Further, Consol Agents and Freight Forwarders shall publish/ display charges on account of load port/ transit expenses in Master Bill of Lading and any other additional expenses due at discharge port. Failing to publish the aforesaid information within 15 days of publication of this notice will lead to action under Regulation 12 of the said regulations. Complaints, if any, received from the importers/passengers about overcharging by Customs Cargo Service providers including Console Agents/Freight Forwarders/ will be viewed very seriously and investigated and action under Regulation 12 of HCCAR,2009 will be taken. This Public Notice is issued in public interest and as per Reg. 6 (3) of Handling of Cargo in Customs Areas Regulations 2009. It shall be displayed in the website of this Custom House. All Customs Cargo Service providers including Console Agents/Freight Forwarders, ICDs and CFSs are also directed to display them in their own websites as compliance to the above regulation. (JANE K.
