24X7 Customs Clearance Operations in respect of identified categories of import and export goods- Regarding - Customs - 56/2015Extract GOVT. OF INDIA MINISTRY OF FINANCE DEPARTMENT OF REVENUE OFFICE OF THE COMMISSIONER OF CUSTOMS COMMISSIONERATE (IV) CUSTOM HOUSE, CHENNAI 600001 F No : S Misc.226/2010-Docks Admn(Pt) Dated: 03.03.2015 PUBLIC NOTICE NO. 056/2015 Sub : 24X7 Customs Clearance Operations in respect of identified categories of import and export goods- Regarding. Attention of Importers, Exporters, Chennai Port Authorities, Customs Brokers, Terminal Operators, Shipping Lines and all Stakeholders is invited to Central Board of Excise and Customs (CBC) Circular No. 22/2012-Customs dated 07.08.2012 issued vide F.No. 450/25/2009-cus IV on the above subject regarding 24X7 Customs clearance of identified categories of Import and Export cargo on a pilot basis. In this regard attention is also invited to Public Notice No:182/2012 dated NIL and Standing Order No:43/2012 dated 30.08.2012 issued by Chennai Customs House regarding commencement of 24X7 clearance at specified CFSs w.e.f 01.09.2012 on a pilot basis. 2. The CBEC vide Notification No. 77/2014-NT dated 16.09.2014 issued from F No.437/48/2014-Cus IV re organized the field formations and created 10 Commissionerates in Chennai Customs Zone with effect from 15.10.2014. Accordingly, the Chief Commissioner of Customs, Chennai Customs Zone, vide Public Notice No:1/2014 dated 10.10.2014 issued from F No:S2/174/2011-CCO(Admn) specified the jurisdictions and functions of each of the newly created Commissionerates and all the Container Freight Stations/lnland Container Depots in Chennai Seaport were divided into 4 clusters under the jurisdiction of Commissionerate II, Commissionerate IV, Commissionerate V and Commissionerate VI respectively. 3. The CBEC vide Circular No:19/2014 dated 31.12.2014 issued from F No 450/25/2009-cus has decided to extend the facility of 24X7 Customs clearance for specified import and export goods to 14 more Seaports including Chennai Seaport w.e.f 31.12.2014. 4. In pursuance of the guidelines of CBEC under reference, it has been decided to introduce 24 X 7 Customs clearance of identified categories of Import and Export cargo, as detailed in Para 5 below, at the following Container Freight Stations/lnland Container Depot which are coming under the jurisdiction of Chennai IV Commissionerate with effect from 05 .03.2015: 1. M/S. Sattva Hitech and Conware Pvt Limited 2. M/S. Triway CFS Pvt Ltd 3. M/s.Gateway Distriparks (South) Pvt Ltd 4. M/S. Indian Corporate Business CentreLimited 5. M/S. Balmer Lawrie and Co Ltd 6. M/S. Sattva CFS and Logistics Pvt Ltd 7. M/S. Kailash Shipping Services Pvt Ltd 8. M/S. Inland Container Depot, Tondiarpet 5. To operationalise the 24 X 7 Customs clearance facility at all CFSs/ICD in Chennai IV Commissionerate, the Customs Officers will be stationed at M/S. Sattva Hitech and Conware Pvt Limited CFS , 126 A, Ponneri High Road, Chennai - 600 103, for the time being, from 08 PM to 08 AM to attend to clearance of the following identified category of Imports and Exports: A. IMPORTS - RMS facilitated Bills of Entry where no assessment and no examination is required This will cover all the self assessed Bills of Entry, including those filed by ACP Clients, facilitated by the Risk Management System (RMS) which require No Assessment and No Examination treatment. It may be noted that even though the RMS decides to give appraisal and examination waiver, the Out of Charge function would not be dispensed with and Customs clearance in terms of Section 47 of the Customs Act, 1962, will continue to be given by the Proper Officer after due scrutiny of documents pertaining to each and every Bill of Entry. B. EXPORTS - Factory stuffed export containers and export consignments covered by Free Shipping Bills 6. All the Importers, Exporters and Customs Brokers, who are desirous of clearing identified category of Imports and Exports between 08 PM and 08 AM at CFSs/ICD, coming under jurisdiction of Chennai IV Commissionerate, are requested to approach the Customs Officers stationed at the said CFS for registration of Bills of Entry / Shipping Bills in the EDI System after obtaining mandatory clearance, if required, from FSSAI, Additional Drug Controller , Plant Quarantine etc in advance. Thereafter, the Proper Officer will register the BE/SB and give Out of Charge / Let Export Order, as the case may be, after ensuring adherence to Compulsory Compliance Requirements (CCR) prescribed by RMS on the Bills of Entry. The Custodian of all CFSs/ICD shall provide necessary infrastructural arrangements including transport and basic amenities etc., for 24X7 clearances. Rotation and posting of Customs Officers for clearance of identified category of Imports and Exports will be posted in the Chennai Seaport Customs Website/Docks Office Notice Board and the same will also be available with all the CFSs/ICD. 08.
