Transfer of goods imported at Courier Cell, Air Cargo Complex, Bangalore - Procedure for transhipment of cargo and filing of Bills of Entry through EDI of such transferred cargo.-Reg. - Customs - 11/2014Extract OFFICE OF THE COMMISSIONER OF CUSTOMS P.B. No. VIII/48/30/2013.Cus.Tech Date: 19.05.2014 PUBLIC NOTICE No. 11/2014 Sub: Transfer of goods imported at Courier Cell, Air Cargo Complex, Bangalore - Procedure for transhipment of cargo and filing of Bills of Entry through EDI of such transferred cargo. - Reg. The Courier Imports and Exports (Clearance) Regulations, 1998, do not apply to certain categories of goods, as listed in Regulation 2(2) ibid. Therefore, as per present practice, the goods which are not allowed to be cleared through courier mode, if so received, are transferred to the Air Cargo Complex for further processing. It is proposed to codify extant practice by way of this Public Notice. 2. Having regard to Courier Imports and Export (Clearance) Regulations, 1998, and the Circular No.56/95-Cus dated 30.5.1995 and Circular No. 85/98-cus dated 13.11.1998, issued by the Board, the following procedure is laid down for clearance of such consignments. 3. On delivery of the Import Manifest by the Airlines electronically to the proper officer under Section 30 of the Customs Act, 1962 including the Cargo Manifest containing the details of the cargo to be landed and the cargo to be transhipped, the Authorised Courier should file the CBE-I which will cover all the consignments in the specific Master Air Way Bill destined for the Courier Terminal. The goods shall be brought to the Courier Terminal which will be received by the Shift Inspector who will endorse the CBE-I in of the goods having been received in tie Courier Terminal and ensure that the goods are placed in a designated, secure and safe area. The Authorized Courier will thereafter file the corresponding CBE-II containing the details of the House Air Way Bills. Those consignments which are to be cleared in the Courier Terminal will be cleared as per the Act, Rules, Regulations, Instructions issued, from time to time, and the Public Notice No.69/2005. The goods for transhipment would also be cleared by following the relevant Rules, Regulations, etc., and the Public Notice No. 41/2012. 4. In those cases where the goods are not covered under Regulation 2(2) of CIECR and where the authorisations have been received from the Consignee/Consignor or Customs Broker declaring the need to clear the consignments from Air Cargo, the concerned Authorised Courier will proceed to segregate the goods in the designated earmarked area to be transferred to Air Cargo Complex. The cargo should be sorted MAWB-wise and the transfer should be clearly reflected by way of endorsement in the CBE-II against the particular HAWB. Thereafter the Authorised Courier shall prepare the Cargo Transfer Manifest (CTM), flight-wise, in quadruplicate indicating details of the shipment. The format of CTM is annexed (Annexure A). The four copies shall be used as under: (i) First copy to be retained by the Shift Inspector/Superintendent concerned, Courier Cell. (ii) Second copy for the Courier Cell custodians i.e., EICI or DHL Express (I) Pvt Ltd, as the case may be, for their records. (iii) Third copy for Air Cargo Custodians viz., Menzies Aviation Bobba Terminal or Al SATS, as the case may be, to receive the package into their Import Warehouse, and (iv) Fourth copy shall be returned to the Shift Inspector/Superintendent, Courier Cell after transfer of cargo as detailed in para 14 below. 5. All Authorised Couriers intending to avail CTM procedure have to execute a revolving Bond akin to the Transhipment Bond for the value of duty estimated for a week's cargo transfer accompanied by 10% BG with AC/DC, Courier Cell. The Bond will be debited as and when the goods are taken out from the Courier Terminal. The Cargo Transfer Manifest i.e, CTM (referred in para 4 above) will be prepared by the Authorised Courier, listing the HAWB No. and related details of all the packages for which transfer is requested and submitted to the Shift Inspector/Superintendent, Courier Cell, for entry in the CTM Register. The Shift Inspector/Superintendent, Courier Cell shall then enter the CTM number on all the four copies of the CTM, and after endorsement, shall retain the first copy of CTM. The Shift Inspector shall then verify whether the number of consignments proposed to be transferred in the CTM matches with the endorsement by the Authorised Courier on the CBE-II entry indicating the transfer of the parcels to ACC and also verify that the revolving bond is properly debited. The Noter (Appointed by the Custodians for allotment of B/E numbers), shall record the CTM number against the relevant HAWB number in the Courier Bill of Entry-Il and endorse the CTM. The Shift Inspector/Superintendent concerned, Courier Cell shall also maintain a separate register (CTM details register) for recording all the relevant details as mentioned in Annexure 'Al and those required to monitor receipt of goods by the Menzies/AI SATS. 6. The Deputy/Assistant Commissioner of Customs, Courier Cell may, after verification of details declared, permit such shipment under (TM to be transferred to the relevant Custodian in the Air Cargo Complex, KIAL, Bangalore for further clearance through Customs. On Sundays, holidays and in Night shift, the Shift Superintendent may permit the transfer and obtain the post-facto approval of the DC/AC, Courier Cell on the next working day. 7. The Authorised Courier Company after obtaining permission from the Deputy/Assistant Commissioner, shall seal such shipments with Customs seal in the presence of the Shift Inspector/Superintendent, Courier Cell. 8. The concerned Authorised Courier will give the Custodian of Courier Terminal a copy of the CTM and arrange to transport the consignment from Courier Terminal to the Menzies/AI SATS Import Warehouse located in the Air Cargo Complex. For this, they may avail the services of the Menzies/AI SATS, concerned Airline. The Shift Inspector/Superintendent, Courier Cell attending to the transfer at Courier Terminal will put a forwarding remark on the CTM mentioning the number of packages being forwarded to the Air Cargo Complex. 9. The Cargo Custodian or the Airline appointed by the Authorised Courier to move the goods from Courier Complex to Cargo Complex through the Airside of the Airport shall transfer such sealed shipments along with the CTM to the Custodian i.e., the Menzies/AI SATS at Air Cargo Complex and obtain acknowledgment from IFO/Superintendent (Transshipment) and the Menzies/AI SATS on the CTM, for receipt of such shipments at Air Cargo Complex. 10. The Authorized Courier shall file a request with Assistant/Deputy Commissioner, IGM, for amending the corresponding MAWB to the extent the goods have been transferred in the CTM. Thereafter, the Authorised Courier will prepare and file a Consol Manifest for the details in the CTM using their Consol code following the same procedure by which the registered consol agents file Consol Manifest for their respective MAWB numbers at Air Cargo Complex. 11. Entry inward of the CTM has to be entered by Superintendent (Transhipment) at ACC and endorsed. After physical verification and preparation of segregation report by the Menzies/AI SATS, the Superintendent (Transhipment) shall endorse all the three copies of the CTM. 12. The third copy of CTM duly endorsed by Superintendent (Transhipment) and the representative of Menzies/AI SATS will be forwarded by the respective Cargo Custodians along with the segregation report and the hard copy of IGM, to IGM section at the Air Cargo Complex for completion of procedure as applicable to other regular IGMs. 13. Thereafter, clearance procedures such as filing of Bill of Entry and processing thereof, shall be done as per Customs clearance procedure, applicable to goods imported in cargo mode by any normal flight. 14. The Authorized Courier will submit Fourth Copy of the CTM which has been duly signed by the representatives of Menzies/AI SATS and Superintendent (Transhipment), to the Shift Inspector/Superintendent, Courier Cell within seven days from the date of transfer of cargo from Courier Cell to ACC who in turn will close the entry in CTM Register thereafter and credit the Transhipment Bond appropriately, which was earlier debited as per procedure indicated in para 5 above. 15. The second copy of the CTM will be handed over to M/S. EICI/DHL Express (I) Pvt. Ltd, the Custodians at Courier cell for maintaining records. 16. M/S. EICI/DHL Express (I) Pvt. Ltd shall maintain a register entering the details of such shipments transferred to the Air cargo Complex, for clearance by duly authorized CHA/Authorised Courier. 17. All concerned are advised to comply strictly. Practices, if any, followed by any Authorised Courier that are divergent to the above procedure should be stopped forthwith.
