PUBLIC NOTICE NO. 135/2008, DT. 15/01/2009 Duty Exemption/Remission Scheme - EO Period and its Extension amended. A new Appendix 30A also added In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy 2004-2009, the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures, Vol. 1 (RE 2008): 1. Paragraph 4.22 related to Export Obligation (EO) Period and its Extension stands replaced by the following: "4.22. Fulfillment period of EO under Advance Authorisation shall commence from Authorisation issue date, unless otherwise specified. EO shall be fulfilled within 24 months except in case of supplies to projects/turnkey projects in India/abroad under Deemed Export category where EO must be fulfilled during contracted duration. EO period for Advance Authorisations issued with input(s) as mentioned in Appendix 30A shall be as per the period stipulated against each entry therein. Facility of extension of EOP shall not be allowed in case of Advance Authorisation issued for these inputs. RA shall make an endorsement in Advance Authorisation to this effect." 2. 3rd Sub-paragraph of paragraph 4.22.1 as mentioned below stands deleted: "Facility of extension of EOP shall not be allowed in case of Advance Authorisation wherein import of penicillin and its salts (ITC(HS) Code No.29411010) and 6-APA (ITC(HS) Code No.29411050) have been allowed as an input and also for import of spices and tea. RA shall make an endorsement in Advance Authorisation to this effect." 3. A new Appendix i.e., Appendix 30 A stands added in the HBP v1 (Appendices Aayaat-Niryaat Form). Export Obligation Period 1) Spices (a) Import of Spices for Value Addition purpose like crushing/grinding/sterlisation or for manufacture of oils and oleoresins of pepper; cardamom and chillies and not for simple cleaning, grading, repacking etc. 1 [ "However, for imports completed up to 31.12.2008, Export Obligation Period (EOP) shall be 150 days from the date of clearance." ] 120 days from the date of clearance of first consignment by Customs Authority. (b) Spices (other than pepper, cardamom and chillies) for manufacture of Spice oils and Oleoresins. 12 months from the date of clearance of first consignment by Customs Authority. (c) Other than (a) (b) above. 90 days from the date of clearance of first consignment by Customs Authority. 2) Drugs (with a specific export order and pre-import condition). 6 months from the date of clearance of first consignment by Customs Authority. 3) Penicillin and its salts (ITC(HS) Code No.29411010) and 6- APA (ITC(HS) Code No.29411050) 6 months from the date of clearance of first consignment by Customs Authority. 4) Tea 6 months from the date of clearance of first consignment by Customs Authority. 5) Coconut Oil 90 days from the date of clearance of first consignment by Customs Authority. ---------------------------------------------- Notes:- 1.
