Date:- 20.05.2009 PUBLIC NOTICE NO. 11/2009 Sub: Goods imported at Courier Cell, transshipment to Air Cargo Complex, Sahar, Mumbai, procedure for transshipment and computerized processing of such transferred consignments Reg. Consequent upon re-location of the Courier Cell in Mumbai Airport to the enclosure at Belt No. 12 in Terminal 2C, declared as Customs area for clearance of Courier shipments vide Public Notice No. 15/2008 dt 31.12.2008, representations have been received from the BCHAA i.e. Bombay Custom House Agents Association. The BCAA have expressed difficulties in clearance of Courier shipments, in view of the limited access to the Customs area in Terminal 2C for security reasons. The matter has been examined and it has been decided to facilitate clearance of Courier shipments by CHAs having authority from the respective consignees to clear such shipments through the Air Cargo Complex, Sahar, Mumbai 400 099. 2. Having regard to Courier Import and Export (Clearance) Regulations, 1998, Public Notice No. 20/98 dated 08.12.1998 and CBEC Circular NO. 56/95 dt 30.05.1995, No. 85/98 dt 13.11.1998 and Circular No. 6/2007 dt 22.01.2007 ( w.r.t. TP Procedure), the following procedure shall be adopted for clearance of such Courier shipments: (1) Any consignee, or his Custom House Agent holding valid authorization from the consignee, wanting to clear a courier consignment through Air Cargo Complex shall inform the concerned courier about the need to clear the particular consignment through Air Cargo Complex. (2) Based on the letter from the consignee or CHA, the concerned Courier shall immediately prepare Cargo Transfer Manifest (format attached Annexure A ) in quadruplicate indicating details of the shipment. The four copies shall be used as under: (i) First copy for Courier Cell Noter (ii) Second copy for the Courier Cell custodian i.e. EICI for their records (iii) Third copy for MIAL to receive the package into their warehouse in Air Cargo complex, and (iv) Fourth copy for the agency moving the shipment from the air side of the Courier Cell to MIAL Air Cargo Complex Import warehouse. (3) A Cargo Transfer Manifest i.e. CTM will be prepared by the Courier and submitted to the Noter of the Courier cell for obtaining file number on the CTM which will be maintained by the Noter in a separate register. The Noter shall record the CTM number against the relevant Thoka No. and endorse the CTM. The Noter at Courier Cell shall maintain a separate register for recording all the relevant details such as those in Annexure A and those required to monitor receipt of goods by MIAL. (4) The Deputy/Assistant Commissioner of Customs, Courier Cell may, after verification of details declared, permit such shipments under the CTM to be transferred to the Air Cargo Complex, Sahar, Mumbai for further clearance through Customs. (5) The authorized Courier Company after obtaining permission from the Deputy/Assistant Commissioner, shall seal such shipments with customs punch seal in the presence of the Preventive Officer posted for consignments relating to Form V, Courier Cell. (6) The concerned Courier will give the Custodian a copy of the CTM and arrange to transport the consignment from Courier Cell to MIAL s Import Warehouse in Air Cargo Complex. For this they may take the services of MIAL, concerned airline or their ground handling agent. The Courier Preventive Officer will put a forwarding remark on the CTM mentioning the number of packages being forwarded to the Air Cargo Complex. (7) The agency appointed by the Courier to move the goods from Courier Complex to Cargo Complex, shall transfer such sealed shipments alongwith the CTM to the Custodian i.e. MIAL at Air Cargo Complex, Sahar and obtain acknowledgment from Batch Officer as well as MIAL on the CTM for receipt of such shipments at the Air Cargo Complex, Sahar. (8) The authorized courier shall file an electronic IGM with customs corresponding to the CTM as if a virtual flight has taken place. For this purpose they will use code of their own airline i.e. Fedex will use code of Fedex Aviation, UPS will use code of UPS Aviation etc. The Couriers which do not have their own airlines may take support of any of the registered airlines. Each CTM will have a unique number assigned by the Airlines which number will correspond to number of master airway bill for normal flights (as indicated in Annexure A ). The Authorised Courier will issue a Delivery Order to the importer or his agent as per standard procedure. (9) Entry inward of the IGM has to be entered by IFO in Batch. (10) The CTM duly endorsed by Batch Officer and MIAL will be forwarded by the Custodian i.e. MIAL to Noter in EDI at the Air Cargo Complex, and hard copy of IGM to CMC for completion of procedures applicable to normal IGMs. (11) Thereafter, clearance procedures such as filing of Bill of Entry and processing thereof, shall be done as per customs clearance procedure, applicable to goods imported by any normal flight. (12) The Authorized Courier will submit a copy of the CTM which has been duly signed by MIAL and Air Cargo Complex, Batch Officer to the Noter of the Courier Cell within seven days from the date of transfer of cargo from Courier Cell to Air Cargo Complex. On receipt of copy of CTM duly acknowledged by MIAL and batch officer the Noter in Courier Cell shall, close the entry. (13) The quadruplicate copy of the CTM will be retained for records by EICI, the Custodian at Courier cell. (14) The EICI shall maintain a register showing all the relevant details of such shipments transferred to the Air Cargo Complex, for clearance by duly authorized CHA. 3. This procedure is an interim measure devised to resolve the difficulties faced by CHAs in the clearance of Courier shipments imported at the Courier Cell, airport and shall be followed by all concerned i.e. the Courier Cell, the Courier companies, M/s EICI, M/s MIAL, the CHAs and the Air Cargo Complex, till such time that the proposed new courier terminal at CSI Airport becomes operational. 4.
