OFFICE OF THE COMMISSIONER OF CUSTOMS KACHCHH - KANDLA F.No.S/01-01/2007-Appg.(G) Public Notice No. 23/2007 Dated : 24/05/2007 Sub. : Drawal of Samples and Testing in Chemical Laboratories reg. The samples are drawn in the Custom House under Section 144 of the Customs Act, 1962 for ascertaining the correct classification and valuation. The samples are forwarded to Customs Revenue Laboratory Kandla or to a approved Government Laboratories like CIPET Ahmedabad, CRCL Vadodara etc. in case where there is no facility to have the test done at the Custom House Laboratory. Efforts are being made to conduct all possible tests in Kandla Laboratory to expedite speedy testing so that import consignments are not held up for want of test reports. The priority is given to the live consignments and in other cases testing will be completed within 15 days of the receipt of the samples. The Test Reports take more time when they are sent to a Laboratory out side Kandla. In such cases the importers may be encouraged to take delivery of the consignments against Bonds/bank Guarantee, or part consignments where there is no possibility of the goods being confiscated later for violation of any law. In other cases the goods may be allowed to be stored under Section 49 without warehousing so that the goods need not un-necessarily incur demurrage subject to importers making the due arrangements. All the importers/CHAs are requested to contact the Assistant Commissioners of the Group where there is inordinate delay in receipt of Test Results for expediting the process of testing for live consignments. In case the test results are not received within 15 days even in those cases where samples are sent to laboratories out side Kandla, the Joint/Additional Commissioner may be contacted. All the Trade Associations/Chamber of Commerce/Members of Regional Advisory Committees and Custom House Agents Association are requested to publicize the contents of this Public Notice among their members/constituents.
