Non Availability of Benefits under Advance Authorisation or DFIA Scheme - Customs - 60/2008

OFFICE OF THE COMMISSIONER OF CUSTOMS (EXPORT) JAWAHARLAL NEHRU CUSTOMS HOUSE, NHAVA SHEVA DIST RAIGAD, MAHARASTRA - 400707 Date : 05.08.2008 Public Notice No. 60/2008 Attention of all the CHAs, Exporters, members of the trade and all concerned is invited to the DGFT clarifications given as under:- 1. As per para 4.4.3 to be read with para 4.1.13 of FTP, prohibited items of export mentioned in ITC (HS) classification book shall not be exported under the advance authorization/DFIA Scheme, the benefit of these Duty Neutralization Schemes shall not be allowed to the exporter firm even if the exporter had been allowed to export the prohibited item by way of any special dispensation. Accordingly, the exporters of non-basmati rice, after the product had been notified as prohibited or there is ban on export of the said product, shall not be allowed the benefit of Advance Authorisation/DFIA for exports during the said period. 2. This is brought to the notice of all concerned that in view of the above, the benefit of Advance Authorisation/DFIA schemes are not to be allowed to the exporter firm even if the exporter has been allowed to export the prohibited items by way of any special dispensation. Hence the exporters of non-basmati rice shall not be allowed the benefit of Advance Authorisation/DFIA after it has been notified as prohibited or was banned for export. 3.
