No. S/26-274/2001 Apprg (Gen) Dated : 27/08/2001 Public Notice No. 96/2001 Sub : Computerised Processing of Bills of Entry Under the Indian Customs EDI System Imports (ICES/I) at the Custom House- Mumbai Attention is invited to Public Notice No.85/99 dated 29.09.1999, on Computerized Processing of Bills of Entry under the Indian Customs EDI System. In this Public Notice certain categories of Bills of Entries were not considered for processing in EDI. It has now been decided to process the following categories of Bills of Entry also in EDI w.e.f. 10.09.2001. I. PROVISIONAL ASSESSMENT WITH R. D. (GVC CASES):- Under the existing orders 1% or 5% R. D. as the case may be, of the Assessable Value is required to be taken in cases where the supplier and the importer are related parties and it need to be examined whether the relationship has influenced the declared value. In such cases, while filing the Annexure at Service center, the Importer/CHA should themselves indicate 1% or 5% of R. D. against the column SVB Loading in the Annexure I of Public Notice 85/99. The Importer/CHA shall submit a copy of the Bill of Entry in GATT Valuation Cell for raising debit to the General Bond A/c. Upon submission of the Bill of Entry with necessary endorsement from GVC, the Assessing Officer shall provisionally assess the Bills of Entry in EDI. In case Importer/CHA has failed to include the 1% or 5% R.D, the Assessing Officer shall charge the required R. D. in the above manner. II SHIP STORES:- The into bond Bs/E covering import of Ship Stores shall be assessed in EDI just like other into Bond Bills of Entry covering normal trade goods intended for clearance for Home Consumption. However, the ex-bond shipping bills will continue to be processed manually. III FAST TRACK:- The facility is available to those who are registered under this Scheme. They include Govt. Organizations, Public sector undertaking, units in export processing zones, 100% EOUs, research institutions, Top 20 importers, Manufacturer-importer of Electronic goods having investment of ₹ 30 crores and above, provided they are not found involved in any proven case of fraud, forgery or suppression of facts. In addition, importers of certain specific commodities are also eligible for this facility. However, certain sensitive goods as enumerated in Para 2 of this Custom House Public Notice No.23/98 dated 23.03.1998 are not covered under this Scheme and shall in all cases be assessed in the normal course. Under the existing provision, for clearance under manual Bills of Entry, open examination is waived clearance in such case is being allowed after checking marks and numbers on the package or the container number and seal as the case may be. Proper assessment/audit is done after clearance of the goods on payment of duty as per the assessment done by the importer. The Bills of Entry covering imports, other than bulk cargo and the goods excluded from this scheme under the said Public Notice, by those who are registered under this scheme shall be processed in EDI w.e.f., said date under the Green Channel and examination of goods shall be waived as at present and clearance shall be allowed after checking marks and numbers on the package or the container number and seal as the case may be. Normally, the Assessing Officer shall not raise any queries and shall give instruction to the Dock staff to verify requisite documents/catalogue etc., which are relevant to the assessment, before granting out of charge. With this change, the Bills of Entry filed under this scheme shall be assessed on the respective groups as in the case of other Bills of Entry. IV SINGLE WINDOW CLEARANCE: Under Single Window Clearance facility certain imports (excluding bulk) and imports by Govt. Organizations including Public Sector organizations are assessed in a single unit irrespective of the Chapter headings. The examination is also waived barring certain cases where it is found necessary to examine the cargo. Bills of Entry covering imports under this scheme shall also be processed in EDI under Green Channel in the manner proposed for Fast Track Clearance. V DIPLOMATIC GOODS: Diplomatic goods are covered under Notification 3/57 Cus dated 08.01.57 and hence the Bs/E covering these goods shall be assessed in EDI under the Systems Appraisal Scheme. Necessary checking of eligibility to the duty exemption shall be done by the Shed Auditor/Shed Appraiser. 2. Public Notice No. 85/99 dated 29.7.99 and Public Notice No. 23/98 dated 23.3.98 stand modified to the extend indicated above. All concerned are informed to take necessary steps to comply with these instructions.
