No. 473/43/93-LC Dated 1-8-1994 Government of India Ministry of Finance (Department of Revenue) New Delhi Subject : Delegation of powers to Principal Collectors of Customs and Collectors of Customs as per section 152 of the Customs Act, 1962- Reg. On consideration of a proposal received from the Department of Electronics, the Board has taken a decision to delegate the powers for declaration of places as warehousing stations under section 9 of the Customs Act, 1962 in respect of 100% EOUs to the Collectors of Customs. It is expected that this delegation would decentralise decision making and thereby help reducing the delays in setting up a 100% EOUs which in turn will facilitate the export effort. 2. In accordance with the above decision, Notification No. 33/94 (N.T.)-Cus., dated 1-7-1994 has been issued superseding Notification No. 3 4/90 (N.T.)-Customs, dated 18-6-1990. 3. It may be seen that this new notification delegates certain powers of the Board to the Principal Collectors of Customs and the Collectors of Customs whereas the earlier Notification (No. 34/90, dated 18-6-1990) applied also to Principal Collectors of Central Excise and Collectors of Central Excise. This however does not imply that the present notification seeks to exclude these officers for the purpose specified in the notification. It is therefore clarified that the present notification is to be read in conjunction with Notification No. 56/92(N.T.)-Cus., dated 31-7-1992 and Notification No. 58/92(NT)-Cus., dated 31-7-1992. While Notification No. 56/92(NT)-Cus., appoints Principal Collectors of Customs Central Excise and Principal Collector of Central Excise as Collector of Customs, Notification No. 58/92 (NT)-Cus. appoints Collectors of Central Excise. 4. A suitable Public Notice may be issued in each Collectorate highlighting the present facility and cases falling within the purview of the said notification may be suitably dealt with.
