Adjudication and Disposal of Parcels and Packets detained at PAS during the period 2003- March, 2017 - Customs - PUBLIC NOTICE NO. 118/2017Extract OFFICE OF COMMISSIONER OF CUSTOMS (IMPORT-II), NEW CUSTOM HOUSE, BALLARD ESTATE, MUMBAI-1 F. No: S/22-64/2017 PAS Date:29.09.2017 PUBLIC NOTICE NO. 118/2017 Sub: Adjudication and Disposal of Parcels and Packets detained at PAS during the period 2003- March, 2017- reg. Attention is invited of all trade members and individual importers and exporters regarding goods detained by Postal Appraising Section, Foreign Post Office, Mumbai, for various reasons such as prohibition/Restriction on Import of goods by post or non-payment of duty or non furnishing of required documents, etc. Recently, an exercise of inventorisation and examination of 5122 parcels and packets (approximately), detained since 2003 till 31.03.2017 for the above mentioned reasons was conducted. List of 4975 such parcels arranged year wise is enclosed as annexure to this notice. These parcels finding mention in the Annexure are liable for confiscation under the provisions of sections 111 of the Customs Act, 1962 and are pending for adjudication and other such actions under the provisions of the said act. As evident from the details of violation stated against entry for each parcel in the said Annexure, the confiscation is proposed w.r.t following statutory provisions; i) Obscene material as per section 292(i) of the Indian Penal Code read with Section 111 (d) of the Customs Act, 1962 ii) Items requiring WPC license as per Rule 3 of Use of Low Power Equipment in the frequency band 2.4 GHz to 2.4835 GHz (Exemption from Licensing Requirement) Rules, 2005 read with Section 111 (d) of the Customs Act, 1962 iii) Medicines as per form 12B and as their date of expiry is over. iv) Arms and ammunitions as per Arms Act, 1959 read with Section 111 (d) of the Customs Act, 1962 As these goods appear to be liable for confiscation as stated above, the importer also appears to be liable for penalty under section 112(a) of the Customs Act, 1962. Accordingly, importers as per the list enclosed are here by asked to show cause to Asst./Deputy Commissioner of Customs, of PAS located at FPO, Ballard Estate, Mumbai within 15 days of the issuance of the notice by writing or by causing personal appearance. This notice shall be treated as final notice for the purpose of adjudication, confiscation and further disposal. After the expiry of the period mentioned above, no defence shall be entertained thereof. The annexures running into 216 pages are being uploaded on the website www.mumbaicustomszone1.gov.in also.
