No. S60 (Misc)-152/2018 A (G) Date: 04.01.2019 PUBLIC NOTICE NO. 04/2019 Subject: Procedure in respect of 24x7 Direct Port Delivery (DPD)/Direct Port Entry (DPE) by Rail movements between NSD Balmer Lawrie CFS Attention Of all concerned is invited to earlier Public Notice Nos. 04/2018 dated 12.01.2018 68/2018 dated 13.07.2018 on Direct Port Delivery CDPD). 2. The facility of DPD/DPE is being further extended by including and utilizing designated area of M/S Balmer Lawrie CFS. Kolkata Port Trust and M/S Balmer Lawrie have entered into a Memorandum of Understanding (MOU) on 02.11.2018 for setting up an Extended Gate Common-user Facility at M/S Bah-ner Lawrie CFS premises at Kolkata for decongesting the roads by improving the Rail co-efficient of the Ports cargo and thereby reducing the time taken for movement of containers into and out Of Kolkata port terminals. 3. M/S Balmer Lawrie will be acting as a service provider in handling of Containers and supply of rakes for carriage of containers with the objective of evacuating containers err-mass by rail and facilitating trade with reduced transit time at economical tariff. Kolkata Port will also coordinate with terminal operators inside Port in effectively utilizing the Extended Gate Common-user Facility. 4. In order to speed up the delivery of containers to the port and vice versa and also to reduce the congestion inside the port, a 3500 square meters area of M/S Balmer Lawrie CFS at Kolkata is declared as designated area for operating the facility of Direct Port Entry (DPE) and Direct Port Delivery (DPD). 5. This facility will be available to all AEO clients and REID self sealed export containers. DPD facility shall also be available to the Importers as listed in the earlier Public Notice Nos. 04/2018 dated and 68/2018 dated 13.07.2018 and as notified time to time. 6. This facility is expected to reduce export and import dwell time and facilitate ease of doing business. 7. Procedure to be followed for entry of Export Containers by Rail into M/S Balmer Lawrie CFS under 24x7 DPE facility: 7.1 All export goods laden containers shall enter the M/S Balmer Lawrie CFS's DPE facility at Kolkata along with the Check List of the Shipping Bill filed through ICEGATE. 7.2 The Preventive Officer shall verify Shipping Bill Check List, container number, seal number and integrity of seal using REID scanner before the entry of the container into the M/S Balmer Lawrie CFS's DPE Facility at Kolkata. In case, the officer finds that the container/ seal has been tampered with, the mandatory examination would be carried out by the Customs officers posted at this CFS Direct Port Entry (DPE) facility. 7.3 The Examining Officer (Proper Officer) shall verify the documents and register the Shipping Bill in ICES at the CFS Direct Port Entry (DPE) facility. If there is more than one container in a Shipping Bill, then registration shall be done after consolidation of all containers. 7.4 If an export container is selected for inspection / examination by the Risk Management System, then RMS instructions shall be executed by the Examining Officers (Proper Officer) and such container shall be inspected / examined at the designated examination area within the CFS Direct Port Entry (DPE) facility. Thereafter such inspected/ examined containers shall be re-sealed by the designated Preventive Officer using Customs bottle seal (OTL) immediately in the presence Of Examination Officers and Exporter/ CHA. 7.5 On completion of inspection Or examination, as the case may be, the Superintendent of Customs shall give let Export Order (LEO) in the system. The LEO granted container(s) shall move to the port by Rail with the exporter's copy of the Shipping Bill as well as the gate pass, issued by M/S Balmer Lawrie CFS. 7.6 The designated Preventive Officer at Kolkata port shall give Allowed for Shipment on the hard copy of the Shipping Bill as per the usual procedure after verification of Let Export Order (LEO). 8. Procedure to be followed for availing DPD of import containers carried by Rail through M/S Balmer Lawrie 24x7 DPD Facility. 8.1 The said M / s Balmer Lawrie CFS DPD facility will be treated as designated CFS for DPD Containers. 8.2 DPD importers who wish to take delivery Of their DPD containers through M/S Balmer Lawrie CFS DPD facility shall give advance intimation to Shipping Lines for filing destination code against DPD containers in IGM as BLANK as in the case of normal DPD clearances from port. 8.3 A separate area should be earmarked for storage of the DPD containers by the M/ s Balmer Lawrie. 9. Responsibility of M/S Balmer Lawrie in handling DPD/DPE containers: 9.1 The custodian of the notified Direct Port Entry (DPE) facility will be M/ s Balmer Lawrie CFS, Kolkata. 9.2 M/S Balmer Lawrie CFS may issue advisory for Exporters/ Trade prescribing timeline/cut-off time meant for export containers for connecting the vessels. 9.3 Transportation of DPE and DPI) containers from Kolkata Port to M/S Balmer Lawrie CFS DPD/DPE Facility and vice versa by rail will be the responsibility of M/ s Balmer Lawrie. 9.4 Designated area for providing the facility of Direct Port Entry (DPE) and Direct Port Delivery (DPD) shall be delineated prominently on ground. 9.5 M/ s Balmer Lawrie CFS shall provide facilities in newly notified DPD/ DPE facility area for verification of container number and seal by Customs Officers and facilitate proper on-wheel inspection of DPE containers by Customs at the entry gate. If Shipping Bill is selected by RMS as open and examination, based on the request from the Customs, M/S Balmer Lawrie CFS have to facilitate open examination of the said container. 9.6 A separate area should be provided for storage of the DPE containers by the M/ s Balmer Lawrie. 9.7 The D PE container can be permitted to exit by rail under a Train Summary/Excel Sheet indicating the Container NO., Seal NO., and the time of exit. This will be produced to Customs by CFS Bah-ner Lawrie before departure of Train to Kolkata Port. 9.8 M/S Balmer Lawrie CFS shall facilitate expedited transport of the export containers by deploying adequate number of staff logistics. 9.9 M/S Balmer Lawrie CFS should organize the entry and exit gates in such a manner that there is a smooth movement of the trailers within the yard. 9.10 The service centre shall be made operational on 24x7 basis in order to print the Shipping Bills after granting LEO by M/S. Balmer Lawrie CFS. M/S. Balmer Lawrie CFS will enter into contract with service provider accordingly. 9.11 M/S Balmer Lawrie CFS shall intimate the tariff for export containers. Further, they shall adhere and publish the same as per the latest guidelines. 9.12 It is the responsibility of M/S Balmer Lawrie CFS to ensure that once any container has entered the yard within the prescribed time limit, the export containers is transferred / connected to the destined terminal within time subject to compliance of Customs Act or any other law. In case of delay by M/S Balmer Lawrie CFS all the charges charged by Terminals for entry of export container into Terminals beyond prescribed time should be borne by M/S Balmer Lawrie CFS, without passing on go the Exporters/ Trade. 9.13 They should comply with the provisions of the Handling of Cargo in Customs Areas Regulations, 2009 . 10. No extra charges to be levied: DPE DPD facilitation aim at reducing the dwell time and cost of the import/export. Hence, levying any extra charges will be detrimental to the facility. 10.1 Steamer Agents/ Shipping Lines should not insist/ pressurize any extra condition on the Exporter for deposits/ documents/extra charges etc. to avail DPE and DPD facility through M/S Balmer Lawrie. 10.2 Permissions required from Participatory Government Agencies (PGAs) for DPE containers are to be given on priority basis. 11. Normal time limit for clearance of DPD Containers from Port is 48 Hours. In the case of failure to do so, the containers thereafter will be shifted by Rail to Balmer Lawrie CFS within 72 Hours of landing in the Port Terminal. In case these containers are not taken clearance from Customs within 72 hours, these will be treated as ordinary/non-DPD containers. 12. Monthly Report on DPE and DPD: 12.1 M/S Balmer Lawrie CFS shall submit a monthly report of exporters availing DPD/DPE facility to Deputy/ Asst. Commissioner of Customs, NSD giving details in prescribed proforma set out as Annexure-A. 12.2 Kolkata Port Trust shall submit a monthly report of DPD/DPE to Deputy/ Asst. Commissioner of Customs, NSD giving details for reconciliation. 13. This Public Notice shall come into force with immediate effect. This facility is in addition to the existing system of movement of Export/Import containers involving CFS, Port and Customs. 14. Difficulties, if any, faced in the implementation of this Public Notice may be brought to the notice of the undersigned for remedial action.
