No. S40 (EDI)-08/2018 Dated: 30/01/2019 PUBLIC NOTICE NO. 10/2019 Subject: Implementation of Export Transhipment (ETP) Module for movement of export cargo from Kolkata Port to Gateway port in ICES. Attention of Exporters / Customs Brokers and the Trade is brought to the issue relating to Transhipment of export goods from Port / CFS s to Gateway Port. 2. A software module for Export Transhipment (ETP) has been implemented in ICES regarding transhipment of containers meant for export from one Port/CFS to any other seaport (Gateway Port) in the country. The procedure for routing of the export goods from CFS s of Kolkata sea port to Gateway Port in other parts of the country, is given below. 2.1 Processing of Shipping Bill: The procedure for filing and processing of Shipping Bill at Kolkata Customs (Port) (till stuffing report if applicable) remains the same as is being done presently. In respect of export transhipment cargo, after stuffing report is given (in case of CFS cargo) or after LEO is granted (in case of RFID esealed cargo) the Exporters / Customs Brokers shall approach the Service Centre at Kolkata Custom House for filing of ETP application in ICES. 2.2 Registration of Bond: A separate continuous bond and bank guarantee (BG) by the Carrier / Custodian needs to be submitted and registered in ICES as Transhipment (TP) Bond. The TP Bond and BG for export are to be registered at Import Noting section of Custom House. If, the TP Bond for import is already registered, same may also be utilized. The carrier agent / custodian providing such bond undertakes the responsibility of transhipment and is referred as Transhipper. 2.3 ETP application: Once LEO has been granted in case of CFS cargo when the procedure for stuffing of goods is completed, the Transhipper shall file the ETP application request using Service Centre at Kolkata Custom House in the format provided vide Annexure I of this Public Notice. The details would be furnished to the Service Centre operator, who after making entry in the system would generate the Checklist for the data entry done in the system. The Transhipper would then verify the Checklist and acknowledge the entry for submission in the system. 2.4 Export Transhipment Approval: After the ETP is submitted for a particular Shipping Bill, the ETP application would then get forwarded to the concerned Appraiser / Superintendent who had given the LEO in respect of the said Shipping Bill at the CFS under Kolkata Port (i.e. INCCU1), for his approval. The Appraiser / Superintendent would verify the ETP application and approve the same in the System. After approval, the ETP Permit would be printed. Based on the copy of the printed ETP approval permit, the Gate Officer shall allow the container to pass out of the CFS gate. The approved printed ETP permit shall accompany the container, being moved to the desired Gateway Port. 2.5 Transhipper responsibility: As soon as the ETP approval permit is given, the bond amount and bank guarantee (if any) for the ETP shall be debited from the bond executed. The Transhipper shall take the responsibility to ensure that the concerned cargo is exported. 2.6 Allowed for shipment: As soon as the cargo reaches the desired Gateway Port through ETP, the officer posted at that Gateway Port after completion of the preventive checks, including verification of Marks Number of the container and integrity of the seals to rule out tampering if any, shall approve Allowed for Shipment entry in the ICES by verifying the particulars from the approved ETP. In case of any tampering of seals or discrepancies noticed by the officers at Gateway Port, the container shall be examined by the Appraiser / Superintendent posted at that Gateway Port after obtaining 'No Objection Certificate' from Kolkata Custom House. 2.7 EGM filing. After the procedure or Allowed for Shipment is completed in the system at the Gateway Port, the Steamer Agent can file the EGM at Gateway Port for the Shipping Bills loaded on to the vessel at the Gateway port. After successful filing of EGM, the bond debited during the ETP approval shall be re-credited. 2.8 Drawback processing: The approval of ETP would serve as EGM for the purpose of export benefits. As soon as the approval for ETP permit is given, the Shipping Bill shall move to Drawback Superintendent queue window for Drawback processing. (Manish Chandra) Commissioner of Customs (Port)
