No. Misc.5 /2005 - Enquiry Dated: 11.04.2008 PUBLIC NOTICE NO: 47 /2008 (Addendum to P.No: 1/2006 dt. 04.01.2006) Sub: Declaration of Container Freight Station of M/s. Ennore Cargo Container Terminal Pvt. Ltd., at Kondakarai, Vallur Village, S.R. Palayam, Chennai 600 120, for handling LCL Import Cargo Procedure to be followed - reg. Attention of the Steamer Agent, Importers, Exporters and the Custom House Agents is invited to this Custom House Public Notice No: 1/2006 declaring Container Freight Station of M/s. Ennore Cargo Container Termianl Pvt. Ltd., situated at Kondakarai, Vallur Village, S.R. Palayam Post, Chennai 600 120 as CUSTOMS AREA for handling of FCL Import and Export Cargo. In exercise of powers conferred under section 8 (b) of the Customs Act, out of the total covered shed area of 30,000 Sq.ft., (measuring 150 feet both on East and West; measuring 200 feet both on North and South), an area of 15,000 Sq.ft. separated from the total area (measuring 150 feet both on East and West; measuring 100 feet both on North and South) is declared as Customs Area for the specific purpose of handling Import LCL Cargo at Container Freight Station of M/s. Ennore Cargo Container Terminal Pvt. Ltd. For handling import LCL Cargo the Custodian shall abide and observe the following procedures: 1. Containers containing LCL import cargo are allowed to be moved from Chennai Port to M/s. Ennore Cargo Container Terminal Pvt. Ltd. by the Steamer Agents and M/s. Ennore Cargo Container Terminal Pvt. Ltd., after getting permission from Dy./Asst. Commissioner of Customs (CMFC) as prescribed in Public Notice No. 19/98, PN No. 111/2002 and PN. 255/2002 and the same shall be destuffed at the CFS by the Steamer Agents concerned / custodian, in the presence of their representative under Customs Supervision. 2. A tally should be taken with reference to the concerned import manifests and line numbers and same shall entered in a separate register to be maintained at the CFS according to Container number wise and should be endorsed individually by the representative of the Steamer Agents / Custodian and the Preventive Officer (Customs) on duty. 3. In case of any shortage / discrepancy noticed at the time of destuffing at the CFS, the same shall be recorded in the register maintained by the Custodian and the same will be endorsed as a token of acceptance by the Preventive Officer, Custodian and Steamer Agent. Further the Steamer Agents shall be responsible for the shortages and action will be initiated under provisions of Sec 116 of the Customs Act, 1962. 4. If any shortage / pilferage takes place after taking over of the cargo by the CFS, then the CFS as a CUSTODIAN shall be responsible for claim made if any by the Importers / their representative (CHA) for such loss / shortage / pilferage. Further, the CFS as a CUSTODIAN shall be liable for payment of duty under sub-section (3) of Section 45 of the Customs Act, 1962. 5. The de-stuffed import LCL cargo should be stacked in the respective godown according to Import General Manifest / Line Number, Container number-wise. Separate godown shall be provided for LCL and FCL Cargo. The Cargo should be kept according to the marks and numbers on the packages for easy identification and examination. 6. The sensitive cargo should be kept in the secured lock fast area provided for the purpose. 7. For disposal of the Unclaimed / Uncleared / Abandoned cargo, the CFS as custodian of the cargo shall follow the statutory provisions of the Customs Act, 1962. 8. The Custodian CFS shall furnish / submit weekly statement to the Dy./Asst. Commissioner of Customs (CFS) and Dy. / Asst. Commissioner (CMFC) showing the details such as number of LCL container (with container numbers), date of receipt / destuffing, Name of the vessel, IGM No., Line No. of packages cleared, No. of packages pending clearance, Name of the Importers and other relevant particulars. The movement of Import LCL cargo to the CFS is an optional facility available to the trading public.
