No. 267/10/92-CX. 8] Government of India Ministry of Finance (Department of Revenue) Central Board of Excise Customs, New Delhi Subject : Neutral Packing in relaxation of Rule 185(1) of Central Excise Rule, 1994 for export purposes - Reg. The issue regarding grant of permission for neutral packing in relaxation of Rule 185(1) of the Central Excise Rules, 1944 has been under consideration of the Board. 2. It was represented to the Board by the trade as well as the field formations that as the Rule 185 requires the exporters are finding it difficult to satisfy such of their foreign customers who insist that the Indian goods be supplied without these markings, to be marketed in different parts of the world. In order to promote the export and to remove the difficulties faced by the exporters, it has been decided by the Government to allow all Collectors of Central Excise to exercise the powers under Rule 185(1). On receipt of applications from the assessees, they may allow neutral packing on goods (all commodities) which are meant for actual export out of India. However, proper check may be exercised by the field formations from the point of view of anti-evasion. 3. After granting the relaxation, a report may be made to Government for post facto approval in each case.
