Subject: Amendment in Import Policy Condition under ITC(HS) 08028010 of Chapter 08 of ITC(HS) 2022, Schedule - I (Import Policy) reg. Kind attention is invited to the Director General of Foreign Trade's (DGFT) Notification No. 36/2015-2020 dated 28.09.2022, issued vide S.O. No.4570(E) on the above captioned subject and the related Public Notice 25/2015-2020 dated 28.09.2022 issued by DGFT (copies enclosed), both of which are self explanatory. 2. Considering that the product, Fresh (green) Areca Nut, is a prohibited item in the absence of the compliance to the policy conditions stipulated therein, the Kolkata Customs Zone may devise an appropriate mechanism for registration of Registration Certificate (RC), debit / utilisation of the quantity in the RC, monitoring validity of the RC, and an overall monitoring mechanism for the effective implementation of the revised policy stipulation. 3. All the Pr. Chief/Chief Commissioners are also hereby requested to kindly bring the contents of this instruction to the attention of all concerned for information. Encl: As above. S.O. 4570 (E) - In exercise of powers conferred by Section 3 read with Section 5 of FT (D R) Act, 1992 , read with paragraph 1.02 and 2.01 of the Foreign Trade Policy, 2015-2020 , as amended from time to time, the Central Government hereby amends the import policy conditions of items under ITC HS 0802 80 10 of Chapter 08 of ITC (HS), 2022, Schedule I (Import Policy) : Exim Code Item Description Existing Policy Existing Policy condition Revised Policy Condition 080280 - Areca nut 08028010 --- whole Prohibited However, import is free if CIF value is Rs. 251/- and above per Kilogram. a) However, import is free if CIF value is Rs. 251/- and above per Kilogram. b) Import of 17,000 Metric Tonnes of Fresh (green) Areca Nut without Minimum Import Price (MIP) condition shall be allowed from Bhutan every year. Such imports are allowed only: i) through LCS Jaigaon (INJIGB) only, and, ii) shall be subject to a valid Registration Certificate issued by DGFT 2. Effect of the Notification: Import of 17,000 MTs of Fresh (green) Areca Nut without Minimum Import Price (MIP) condition shall be allowed from Bhutan every year through LCS Jaigaon (INJIGB), subject lo valid Registration Certificate issued by DGFT. (E): In exercise of powers conferred under paragraph 1.03 and 2.04 of the Foreign Trade Policy (2015-2020), the Director General of Foreign Trade hereby lays down the procedure for Application/Issuance of Registration Certificate(RC) for Import of Fresh (green) Areca Nut under ITC(HS) 0802 80 10 from Bhutan without Minimum Import Price (MIP) condition - 1. For the second half of the fiscal year 2022-23, pro-rata quantity of 8,500 MT of Fresh (green) Areca Nut may be imported without MIP from Bhutan. For the financial year 2023-24 onwards, a total of 17,000 MTs of Fresh (Green) Areca Nut may be imported without MIP from Bhutan. 2. Before effecting any such imports, the Indian importer shall seek a Registration Certificate by applying on the DGFT Website Services Import Management System Apply for Registration Certificate for Imports. 3. The maximum quantity permissible under a Registration Certificate will be 500 MTs. The importer(s) can apply for additional quantities once the quantities already registered have been duly imported. 4. RC shall be valid for a maximum period of 6 months or the end of the financial year, whichever is earlier. Further, DGFT reserves the right to make any changes in the modalities/allocation process at any point of time, as deemed fit. 5. Effect of this Public Notice: Procedure for application/Issuance of Registration Certificate for Import of Fresh (green) Areca Nut under ITC(HS) 0802 80 10 without Minimum Import Price (MIP) condition from Bhutan have been notified.
