With the issue of the Customs (Electronic Cash Ledger) Regulations, 2022 (ECLR) vide Notification No. 20/2022-Customs (NT) dated 30.03.2022, the statutory provisions of Section 51A of the Customs Act, 1962 has come into force on 01.06.2022. However, all the deposits classes were exempted till 31.03.2023, vide Notification No. 47/2022-Customs (NT) dated 31.05.2022, as amended. Further, vide Circular No. 09/2023-Cus dated 30.03.2023, the Board has enabled ECL in phases from 01.04.2023. However, on enabling the said provisions, in some instances, grievances from trade have been received that after payment of the duty the same is not being reflected in ICES and Out of Charge is not getting effected by the ICES. 03. Till the process of integration of ECL with ICES, ICEGATE and Banks become smooth and in order to maintain the uninterrupted flow of supply chain, it has been decided to allow manual Out of Charge (OOC) by the proper officer of customs to the import consignments of following categories of importers on production of a certificate from the Bank as per Annexure-A, indicating the payment of duty, along with an undertaking by the importer that in case duty is not credited to the government account the concerned importer shall deposit the same along with applicable interest, immediately: a. Importers of Perishable Cargo. b. Importers of Pharmaceutical items which move in Cold Chain and other essential commodities c. Importers of Liquid Bulk Cargo and coal. d. AEO Clients. e. DPD Clients. f. Manufacturers. g. Government Departments / PSUs. h. Status Holders under Foreign Trade Policy. 04. Jurisdictional Deputy / Assistant Commissioners of Customs Divisions / Custom Houses are directed to maintain a register of such cases of import of commodities mentioned above. At the end of each day, the jurisdictional Deputy / Assistant Commissioner shall verify the payment with the concerned bank. After verification of the payment from bank, necessary entry may be made in the register. Once the ECL system stabilizes, the jurisdictional Deputy / Assistant Commissioner of customs shall again verify that payment made in bank is duly reflected in the ICES before regularizing the Manual Out of Charge in ICES system. In case of any discrepancy or non payment of duty/interest, the jurisdictional Deputy / Assistant Commissioner shall ensure that the duty and interest are recovered from the importer immediately. 05. Shri Chuna Ram , ADC (Tech) shall act as the Nodal officer to redress the grievances and guide the trade in this regard 06. This Public Notice shall be treated as Standing Order with reference to the officers of the department. 07.
