Minutes of the 122nd meeting of the Board of Approval for SEZs held on 30th August, 2024 at Hyderabad - SEZ - Minutes of the 122nd meeting of the SEZExtract Minutes of the 122nd meeting of the Board of Approval for SEZs held on 30th August, 2024 at Hyderabad The One Hundred and Twenty-Second (122nd) meeting of the Board of Approval (BOA) for Special Economic Zones (SEZS) was held on 30th August, 2024 under the chairmanship of Shri Sunil Barthwal, Secretary, Department of Commerce, at Hyderabad through hybrid mode. The list of participants is at Annexure I. The item-wise decisions taken by the Board are as below: 122.1: Ratification of the minutes of the 121st meeting of the Board of Approval held on 31st July, 2024. The Board ratified the minutes of the 121st meeting of the BoA for SEZs held on 31 st July, 2024. Further, with regard to proposals under Rule 11B, the Board noted that as per direction given in the last meeting, DGEP had shared a checklist with the DoC. Subsequently, the DoC circulated the checklist to all DCs vide letter dated 2nd August, 2024, to examine and provide necessary comments on the same. While none of the Zones had flagged any issue thus far with the draft checklist, formal comments from some Zones were still awaited. During deliberations, none of the DCs flagged any issues except for a minor typo which required correction. Accordingly, the Board directed for adoption of the checklist and directed all DCs to ensure its implementation for all the cases including the past cases. Thereafter, the checklist for all the cases is to be submitted by DCs to DoC which shall be further shared with DGEP. 122.2: Request for extension of validity of LoA of Developer (1 proposal) 122.2 Request of M/s. Tripura Industrial Development Corporation Ltd, a Developer, for further extension of the validity period of the Formal Approval granted for setting up a sector-specific SEZ for Agro Based Food Processing FSEZ. The Board, after deliberations, approved the regularisation of the previous validity of formal approval from 09.12.2023 and further extension of the validity of the formal approval for one year i.e., up to 29.10.2025. 122.3: Request for extension of LoA of Unit (2 proposals) 122.3(i) Request of M/s. Algolog Systems Pvt. Ltd., a unit in Ansal IT City Parks Ltd., IT/ITES SEZ at Plot No. TZ-06, Techzone, Greater Noida for extension of LOA for a further period of one year i.e. up to 31.03.2025 - NSEZ. The Board noted that the proposed investment by the unit is 5.84 crores, and the unit has made a total investment of 4.25 crores since the issuance of its LoA dated 26th October 2015. Further, the unit has made an incremental investment of only 0.73 crores since its last extension. However, the Board observed that the unit does not have a clear business plan. The Board, after deliberations, deferred its decision on the request of the Unit for further extension of the LoA with a direction to DC, Noida SEZ to issue a Show Cause Notice to the Unit as to why their LoA should not be cancelled. 122.3(ii) Request of M/s. Pooja Scrap Industries, a unit in VSEZ for extension/renewal of the validity of the Letter of Approval for a further period of five years i.e., from 31.08.2024 to 30.08.2029 - VSEZ. The Board observed that MoEF CC has not provided any objection/comment on the agenda item. However, DC confirmed that State Government Pollution Board has given its approval. The Board, after deliberations, approved the extension of the validity of the Letter of Approval for a further period of five years, i.e., from 31.08.2024 to 30.08.2029. Further, the Board observed that the Unit s business activities involve the recycling of imported scrap (both ferrous and non-ferrous), as well as providing warehousing services and trading activities. Considering these additional activities, the Board directed that the matter related to the unit s involvement in warehousing services and trading activities may be examined separately. 122.4: Request for Co-Developer status (2 proposals) 122.4(i) Request of M/s. Nobl Q Private Limited for Co-developer status in M/s. Jagirammapalayam, Salem, Tamil Nadu - MEPZ. The Board, after deliberations, approved the proposal of M/s. Nobl Q Private Limited for Co-developer status in the ELCOT SEZ at Jagirammapalayam, Salem for the creation of infrastructure and buildings for their operations and for the prospective Units who have export potential to operate in the field of IT ITES, over an area of 1.011 hectares, in accordance with the Co-developer Agreement dated 24.06.2024 entered into with the Developer (ELCOT) subject to standard terms and conditions as per the SEZ Act and Rules. Further, the Assessing Officer will have the right to examine the taxability of the income by way of lease rentals/down payment/premium, etc. for the purpose of assessment under the prevalent Income-tax Act, 1961 and Income-tax Rules, 1962 as amended from time to time. The lease period shall be in accordance with DoC s Instruction No. 98 dated 29th August, 2019. 122.4(ii) Request of M/s. Artesania Infraprojects LLP, Ahmedabad for approval as Co-Developer within the processing Area in GIFT-Multi Services SEZ at Ratanpur, District Gandhinagar, Gujarat, developed by M/s. GIFT SEZ Limited - GIFT SEZ. The Board, after deliberations, approved the proposal of M/s. Artesania Infraprojects LLP for Co-developer status in the GIFT SEZ Limited at Ratanpur District Gandhinagar, Gujarat for the development of the commercial project on Plot Nos. 15-D, in Block No. 15 over land area admeasuring 5008 square meters. The applicant proposes to construct a building consisting of 4 basements, ground plus 22 floors, in accordance with the Co- developer agreement dated 11.06.2024 entered into with the Developer, subject to standard terms and conditions as per the SEZ Act and Rules. Further, the Assessing Officer will have the right to examine the taxability of the income by way of lease rentals/down payment/premium, etc. for the purpose of assessment under the prevalent Income-tax Act, 1961 and Income-tax Rules, 1962 as amended from time to time. The lease period shall be in accordance with DoC s Instruction No. 98 dated 29th August, 2019. 122.5: Request for Partial/full de-notification (3 proposals) 122.5(i) Request of M/s. Phoenix Spaces Pvt. Ltd. for partial de-notification of 4.37 Ha of their IT/ITES SEZ at Telangana - VSEZ. The Board, after deliberations, recommended the partial de-notification of 4.37 Ha out of 5.77 Ha in respect of M/s. Phoenix Spaces Pvt. Ltd., IT/ITES SEZ, at Sy. No. 285, Puppalguda Village, Rajendranagar Mandal, Telangana. 122.5(ii) Request of M/s. FAB City SPV (India) Pvt. Limited for partial de-notification of 368.80 Ha of their Semiconductors SEZ at Telangana - VSEZ. The Board, after deliberations, recommended the partial de-notification of 368.80 Ha out of 434.86 Ha in respect of M/s. FAB City SPV (India) Pvt. Limited, Semiconductors SEZ, at Hyderabad, Andhra Pradesh. 122.5(iii) Request of M/s. Mindspace Business Parks Pvt. Ltd. for full de- notification of their IT/ITES SEZ at Telangana - VSEZ. The Board, after deliberations, recommended the full de-notification of 4.827 Ha of M/s. Mindspace Business Parks Pvt. Ltd., IT/ITES SEZ at Pocharam Village, Ghatkesar Mandal, Ranga Reddy District, Telangana. 122.6: Miscellaneous (2 cases) 122.6(i) Request of M/s. Aurascent Essence Private Limited for import of Raw (unprocessed) Sandalwood (logs/butts/roots) and export of Processed Sandalwood heartwood logs - SEEPZ. The Board, after deliberations, approved the request of M/s. Aurascent Essence Private Limited for Import of Raw (unprocessed) Sandalwood (logs/butts/roots) falling under HSN Code 44039922 and Export of Processed Sandalwood heartwood logs subject to the condition that entire imported Sandalwood would be exported and would not be diverted to DTA either in raw material or finished form. BoA further directed to DC to ensure proper checks are in place in consultation with Customs. 122.6(ii) Request of M/s. Rain CII Carbon (Vizag) Limited, a unit in M/s. APIIC Multi-product SEZ, Atchuthapuram for import of CPC with reference to CAQM Order dt. 15.02.2024 - VSEZ. The Board, after deliberations, approved the request of M/s. Rain CII Carbon (Vizag) Limited, a unit in M/s. APIIC Multi-product SEZ, Atchuthapuram for import of CPC with reference to CAQM Order dt. 15.02.2024 subject to the following conditions: - (i) adherence to the conditions imposed by para 10(II)(i) of the CAQM order dated 15.02.2024; (ii) only exports will be allowed by M/s. Rain CII Carbon in respect of CPC or its products as per Rule 26 27 of the SEZ Rules, 2006. Any supply to other SEZ units shall be allowed only against specific unutilised import quota of CPC of such SEZ units, if any. Decision on Supplementary Agenda: - 122.7: Co-Developer status proposal (1 proposal) 122.7 Request of M/s. Arasan Infra Limited for Co-developer status and authorized operations in M/s. Adani Ports and Special Economic Zone, Mundra- APSEZ, Mundra. The Board, after deliberations, approved the proposal of M/s. Arasan Infra Limited for Co-developer status in the Adani Ports and Special Economic Zone at Mundra for Development, Operations, and Maintenance of Electricity Transmission Infrastructure Facility including required sub-stations, power lines, backup power storage systems, etc. over an area of 33.5889 hectares, in accordance with the Co-developer agreement dated 06.06.2024 entered into with the Developer, subject to standard terms and conditions as per the SEZ Act and Rules. Further, the Assessing Officer will have the right to examine the taxability of the income by way of lease rentals/down payment/premium, etc. for the purpose of assessment under the prevalent Income-tax Act, 1961 and Income-tax Rules, 1962 as amended from time to time. The lease period shall be in accordance with DoC s Instruction No. 98 dated 29th August, 2019. 122.8: Request for increase/decrease in area by Co-developer (1 proposal) 122.8 Request of M/s. ANSR Global Corporation Private Limited, Co-Developer in Embassy Property Developments Private Limited SEZ, Bangalore for expansion of built-up area- CSEZ. The Board, after deliberations, approved the proposal of M/s. ANSR Global Corporation Private Limited for Inclusion of additional built-up area admeasuring 1,38,572 sq.ft. in Parcel 2 Acacia (11th Floor: 69,737 sq. ft. and 12th Floor: 68,835 sq.ft.) in Embassy Property Development Private Limited to undertake the authorized operation of conversion of bare shell buildings into warm shell buildings, lease the built-up space and to provide facility management services to IT/ITES in accordance with the Co-developer agreement dated 07.08.2024 entered into with the Developer subject to standard terms and conditions as per the SEZ Act and Rules. Further, the Assessing Officer will have the right to examine the taxability of the income by way of lease rentals/down payment/premium, etc. for the purpose of assessment under the prevalent Income-tax Act, 1961 and Income-tax Rules, 1962 as amended from time to time. The lease period shall be in accordance with DoC s Instruction No. 98 dated 29th August, 2019. 122.9: Request for partial/full de-notification (3 proposals) 122.9(i) Request of M/s. New Chennai Township Private Limited for partial de-notification of 44.73 Hectare (110.53 acres) of their Multi-Service, SEZ at Seekinankuppam, CheyyurTaluk, Kancheepuram District, Tamil Nadu - MEPZ. The Board, after deliberations, recommended the partial de-notification of 44.73 Ha out of 121.94 Ha of M/s. New Chennai Township Private Limited, Multi-Service SEZ at Seekinankuppam, Cheyyur Taluk, Kancheepuram District, Tamil Nadu. 122.9(ii) Request of M/s. Span Ventures Private Limited for partial de-notification of 1.22 Ha out of 2.935 Ha of their IT/ITES SEZ at KPM Nagar, Rathinam Software Park, Kurichi Village, Eachanari, Coimbatore District, Tamil Nadu - MEPZ. The Board, after deliberations, recommended the partial de-notification of 1.22 Ha out of 2.935 Ha of M/s. Span Ventures Private Limited, IT/ITES SEZ at KPM Nagar, Rathinam Software Park, Kurichi Village, Eachanari, Coimbatore District, Tamil Nadu. 122.9(iii) Request of M/s. Wipro Limited, Pune for de-notification of the Sector Specific Special Economic Zone for IT/ITES at Plot No. 2, Phase-1, Rajiv Gandhi Infotech Park, Hinjewadi, Taluka Mulshi, Dist-Pune, Maharashtra - SEEPZ SEZ. The Board, after deliberations, recommended the full de-notification of 9.15 Ha of M/s. Wipro Limited, IT/ITES SEZ at Plot No. 2, Phase-1, Rajiv Gandhi Infotech Park, Hinjewadi, Taluka Mulshi, Dist-Pune, Maharashtra. 122.10: Request for Industrial license (1 proposal) 122.10(i) Request of M/s. Raneal Advanced Systems Private Limited, an SEZ unit in KIADB (Aerospace) SEZ, Bangalore for Industrial License under IDR Act, 1951 - CSEZ. The Board noted that M/s. Raneal Advanced Systems Private Limited an SEZ unit in KIADB (Aerospace) SEZ, Bangalore had applied for an Industrial License under the IDR Act, 1951 for manufacturing of the following items: - i. Production, Assembly, and Testing of Microwave Components and Modules for Radar Systems and EW Systems ii. Production, Assembly, and Testing of Microwave Sub-modules for command and guidance units for Missile Sub-systems iii. Repair of Radar Apparatus viz. providing warranty support and carrying out repair of Airborne, Shipborne and Ground-based Radar Equipment (which shall include installation and commissioning support) iv. Integration and Manufacture of Avionics Defence Electronic Equipment V. Production, Assembly, and Testing of Radar Systems and EW Systems Accordingly, the Board after deliberation and taking note of comments received from concerned Ministries/Department, approved the proposal of the unit for grant of Industrial license for the manufacture of only three (03) items as mentioned below only specially designed for military application: i. Production, Assembly, and Testing of Microwave sub-module for command guidance units for missile subsystem ii. Integration and Manufacture of Avionics Defence Electronic Equipment iii. Production, Assembly, and Testing of Radar Systems and EW Systems The items Production, Assembly and Testing of Microwave Components and Modules for Radar Systems and EW Systems are already covered under item Production, Assembly and Testing of Radar Systems and EW Systems . Therefore, no separate license is required for the said item. Further, Maintenance, Repair, and Overhaul activities in the Defence Sector may be treated as Services and should not be subject to industrial license under the IDR Act, 1951. Further, the Board has given direction to DC, CSEZ to ensure that all security instructions architecture prescribed in the Category A of the Security Manual for Licensed Defence Industries issued by MoD from time to time are strictly adhered to in coordination with MoD and MHA. The Board further directed DC, CSEZ to obtain self-undertaking from the unit that they will follow all security guidelines prescribed in the Category A of the Security Manual issued by MoD. 122.11: Request for conversion of processing area into non-processing area under Rule 11(B) (2 proposals) 122.11(i) Request of M/s. Gigaplex Estate Pvt. Ltd. for Demarcation of Built up Floors as Non-Processing Area of a notified IT/ITES SEZ - SEEPZ. The Board, after deliberations, permitted the demarcation of the following processing built-up area as Non-Processing Area in terms of Rule 11B of SEZ Rules, 2006: - S. No. Building no. The Board, after deliberations, permitted the demarcation of the processing built-up area as a Non-Processing Area in terms of Rule 11B of SEZ Rules, 2006. The total area to be demarcated as NPA is 93,194.95 Sq. mt. is as follows: Office Area 25,458.00 Sq. mtrs.
