No. 267/139/88-CX.8] Government of India Ministry of Finance (Department of Revenue) Central Board of Excise and Customs, New Delhi Subject : Declaration filed under Rule 57G - Approval thereof - Instructions regarding I am directed to say that it has been brought to the notice of the Board that in certain Collectorates, prior approval of the declarations filed by an assessees under Rule 57G of the Central Excise Rules is being insisted upon by Central Excise officers. This is causing harassment to the trade. Rule 57G of the Modvat Rules simply requires that an assessee who desires to avail of the Modvat scheme, should file a declaration indicating the description of the final products manufactured in his factory and the inputs intended to be used in each of the said final products and obtain a dated acknowledgement of the same. On obtaining the said acknowledgement, an assessee can immediately start availing credit of the duty paid on the inputs received by him. Under no circumstances, its prior approval is required. Board has therefore directed that the practice of insisting on prior approval of the declaration if being followed in your collectorates may be stopped forthwith. Any departure from these instructions should be viewed seriously. Receipt of this letter may please be acknowledged.
