A reference is invited to Board's letter F. No. 81/50/86-CX.3, dated 29th October, 1986, and to say that in view of the new scheme of excise duty on cigarettes introduced through notification No. 34/87-C.E., dated 1-3-1987, approval of the sale price of cigarettes in terms of old notification No. 201/85-C.E., dated 2-9-1985, as amended, (which has now been rescinded) would no longer be necessary. Consequently, the procedure outlined in terms of Board's letter referred to above shall stand modified. The Director (Audit) shall henceforth consider applications for grant of approval of the surface designs of various brands of cigarettes directly, and after making necessary enquiries and conducting checks as he may deem fit, approve the surface designs, which should ordinarily take not more than seven days from the date of filing of the application by a manufacturer. Thereafter, the Director (Audit) shall communicate his approval simultaneously to the manufacturer as well as to the Collector of Central Excise having jurisdiction over the concerned cigarette factory. The existing arrangement for the approval of specimens of wrappers, outer coverings or labels relating to cigarette packets in terms of rule 93 of the Central Excise Rules, 1944, by the jurisdictional Collectors of Central Excise shall be continued.
