INSTRUCTION NO. 245 /CBDT Dated: December 4, 1970 Section(s) Referred: 40A(3) Statute: Income - Tax Act, 1961 Attention is invited to boards instructions No.213 dated the 3rd september 1970 on the above subject. 2. In view of the fact that amendment to rule 6DD relating to sec.40A(3) has been brought about by the I.T.Rules 1970 dated the 18th November 1970, boards Instruction No.213 is hereby withdrawn with immediate effect. 3. The ITOs may be directed to complete the assessment proceedings for the year 1970-71 and the question of admissibility of expenditure u/s.40A(3) may be decided in each case in the light of the Income Tax (4th amendment) rules 1970.
