Waiver of time limit prescribed u/s 153. - Income Tax - 1824/1989

INSTRUCTION NO. 1824/1989 Dated: August 8, 1989 The board has been receiving a number of proposals from various CCsIT and CsIT requesting for waiver of time limit prescribed u/s.153 of the I.T.Act. While agreeing to such proposals, the concerned CCsIT/CsIT are asked to fix responsibility in the assessments getting barred by limitation. The board, however does not get a feed back from the field formations regarding the action taken against the officer(s)/official(s) responsible for such lapses. 2. With a view to ensuring that prompt action is taken in such cases, it has been decided that while sending proposals for waiver of time limit u/s.153(1) of the act to the board the following information should be furnished by the CCsIT/CsIT:- (i) Names of officers/officials responsible for the lapse and action taken or proposed to be taken against them. (ii) In case it is not possible to fix the responsibility, the reasons therefor. The board desires that the above instructions may kindly be kept in view while sending such proposals hereafter.
