Central Excise Rules - Thirteenth Amendment of 1997

In exercise of the powers conferred by section 37 of the Central Excise Act, 1944 (1 of 1944), the Central Government hereby makes the following rules further to amend the Central Excise Rules, 1944, namely :

1. (1) These rules may be called the Central Excise (Thirteenth Amendment) Rules, 1997.

 (2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Excise Rules, -

(i) in rule 47, in sub-rule (4), the words "the Central Board of Excise and Customs or" shall be omitted;

(ii) in rule 53, in the second proviso to sub-rule (1), for the words "by the Central Board of Excise and Customs", the words "in such order" shall be substituted;

(iii) in rule 54, the words "the Central Board of Excise and Customs or" shall be omitted;

(iv) in rule 57-S, in sub-rule (7), the words "the Central Board of Excise and Customs or" shall be omitted;

(v) in rule 57T, in sub-rule (7), the words "or the Central Board of Excise and Customs" shall be omitted;

(vi) in rule 94, in sub-rule (1), the words "the Central Board of Excise and Customs or" shall be omitted;

(vii) in rule 100D, in the proviso, for clause (b), the following clause shall be substituted, namely :-

"(b) such other particulars as may be specified by the Commissioner;";

(viii) in rule 173H, -

(a) in sub-rule (3), for the words "the Central Board of Excise and Customs or the Chief Commissioner when authorised by the Board may", the words "The Chief Commissioner may" shall be substituted;

(b) in sub-rule (4), the words "or the Central Board of Excise and Customs", shall be omitted;

(ix) In rule 173L, in sub-rule (4), for the words "Chief Commissioner" the word "Commissioner" shall be substituted;

(x) in rule 194, -

(a) in sub-rule (1), the words "the Central Board of Excise and Customs or" shall be omitted;

(b) in sub-rule (3), the words "the Central Board of Excise and Customs or" shall be omitted;

(xi) in rule 197, the words "the Board, the Chief Commissioner or" shall be omitted;

(xii) in rule 224, in sub-rule (1), the words "the Central Board of Excise and Customs or" shall be omitted.".
