Exemption from licensing

Notification No. 26/86-C.E.

In exercise of the powers conferred by rule 174A of the Central Excise Rules, 1944, the Central Government, being satisfied that it is necessary and expedient in the public interest so to do, hereby directs that each of the Notification of the Government of India in the Ministry of Finance, (Department of Revenue and Insurance, or in the Department of Revenue & Banking), as the case may be, specified in column (2) of the Table annexed hereto shall be amended, or further amended, as the case may be, in the manner specified in the corresponding entry in column (3) of the said Table.

1.	No. 55/76-Central Excises, dated the 16th March, 1976.	In the said Notification, for the words, figures and brackets "Item No. 4II (1) of the First Schedule to the Central Excises and Salt Act, 1944 (1 of 1944)", the words, figures, and brackets "Heading No. 24.02 of the Schedule to the Central Excise Tariff Act, 1985 (5 of 1986)" shall be substituted.
2.	No. 202/76-Central Excises, dated the 26th June, 1976.	In the said notification, for clauses (a) and (b), the following clauses shall be substituted, namely :— "(a) chewing tobacco, falling under Sub-heading No. 2404.49 of the Schedule to the Central Excise Tariff Act, 1985 (5 of 1986) ; (b) snuff, falling under Sub-heading Nos. 2404.51 and 2404.52 of the said Schedule,"
3.	No. 3/78-Central Excises, dated the 14th January, 1978.	In the said notification, for the words, figures, and brackets "sub-item 1 of Item No. 19 of the First, Schedule to the Central Excises and Salt Act, 1944 (1 of 1944)", the words and figures "Heading No. 52.05 of the Schedule to the Central Excise Tariff Act, 1985 (5 of 1986)" shall be substituted.
4.	No. 111/78-Central Excises, dated the 9th May, 1978.	In the said notification, — (a) in serial number 1, the words, figures, letters and brackets "falling under sub-item I of Item No. 4 of the First Schedule to the Central Excises and Salt Act, 1944 (1 of 1944)," shall be omitted. (b) in serial number 2, the second proviso shall be omitted ; (c) in serial number 3, the words and figures "falling under item 4II(1) of the First Schedule to the Central Excises and Salt Act, 1944" shall be omitted ; (d) in the Schedule,—
			(i) the brackets and words "(item-wise)", wherever they occur, shall be omitted. (ii) for words "Tariff item/sub-item", the words and figures "Heading No. or sub-heading No." shall be substituted.
5.	No. 41/79-Central Excises, dated the 1st March, 1979.	In the said notification, the words, figures and brackets "falling under sub-item I of Item No. 4 of the First Schedule to the Central Excises and Salt Act, 1944 (1 of 1944)" shall be omitted.
6.	No. 299/79-Central Excises, dated the 8th December, 1979.	In the said notification, in the Schedule,— (a) in serial No. 4, for words and figures "Item No." sub-item of the First Schedule to the Central Excises and Salt Act, 1944" the words, figures and brackets "Heading No. or Sub-heading No. of the Schedule to the Central Excise Tariff Act, 1985 (5 of 1986)" shall be substituted ; (b) in serial No. 5, the brackets and words "(item-wise)" shall be omitted.
7.	No. 2/81-Central Excises, dated the 17th January, 1981.	In the said notification, (a) the third proviso shall be omitted ; (b) in the existing fourth proviso, the words and figures "falling under Item No. 14D of the First Schedule to the Central Excises and Salt Act, 1944 (1 of 1944)" shall be omitted ; (c) In the Schedule—
			(i) in serial No. 4, the brackets and words "(Item-wise)" shall be omitted ; (ii) in serial No. 7, for words "Tariff item/sub-item", the words, "Heading No. or Sub-heading No." shall be substituted.
8.	No. 34/82-Central Excises, dated the 28th February, 1982.	In the said notification, the words, figures, and brackets "falling under sub-item II (3)(ii) of Item No. 4 of the First Schedule to the Central Excises and Salt Act, 1944 (1 of 1944)" shall be omitted.
