Capital goods, components and spares thereof etc. imported under EPCG Scheme - Amendments to Notification Nos. 28/97-Cus. and 29/97-Cus. Notification No. 33/98-Cus. Dated 9-6-1998 In exercise of the powers conferred by sub-section (1) of the section 25 of Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments, in the notifications of the Government of India, in the Ministry of Finance, Department of Revenue, as shown in column 2 of the Table below, as mentioned in column 3 of the said Table, namely :- TABLE Sl. No Notification No. and date Amendment (1) (2) (3) 1. 28/97-Customs, dated the 1st April, In the notification mentioned against serial number 1, in Explanation, in clause (iv) and in the notification mentioned against serial number 2, in 2. 29/97-Customs dated the 1st April, 1997 Explanation, in clause (4) respectively the brackets and letter "(e)" shall be deleted. 3. 29/97-Customs, dated the 1st April,1997. In the notification mentioned against serial number 3, in condition 5, for the third proviso, the following proviso shall be substituted, namely :- "Provided also that the aforesaid condition of minimum value of import which is rupees twenty crores, or rupees one crore, or rupees ten lakhs, as the case may be, shall be deemed to have been complied with where the shortfall in import is within 10% of the limits so prescribed."
