Goods used for drugs or diagnostic kits Notification No. 15/95-Cus. Dated 16-3-1995 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts goods falling under Chapters 5, 28, 29, 30 or 39 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), specified in Column (2) of the Table annexed hereto, when imported into India, from so much of that portion of the duty of customs leviable thereon which is specified in the said First Schedule as is in excess of the amount calculated at the rate specified in the corresponding entry in column (3) of the said Table, subject to the condition that the importer at the time of importation furnishes an undertaking to the Assistant Collector of Customs to the effect that the said goods shall be used for the purpose, if any, specified against each of them in corresponding entry in column (4) of the aforesaid Table. Explanation :- For the purposes of this notification, "bulk drug" means any pharmaceutical, chemical, biological or plant product including its salts, esters, stereo-isomers and derivatives, conforming to pharmacopoeial or other standards specified in the Second Schedule to the Drugs and Cosmetics Act, 1940 (23 of 1940), and which is used as such or as an ingredient in any formulation.
