Effective rates for wind operated electricity generators and parts Notification No. 64/94-Cus. Dated 1-3-1994 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts goods specified in column (2) of the Table and falling within the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), when imported into India, from so much of that portion of the duty of customs leviable thereon which is specified in the said First Schedule as is in excess of the rate specified in column (3) of the Table and from the whole of the additional duty leviable thereon under section 3 of the said Customs Tariff Act, subject to the condition that the importer at the time of importation furnishes an undertaking to the Assistant Collector of Customs to the effect that, - (i) the said goods shall be used for the purposes, if any, specified against each of them in corresponding entry in column (4) of the aforesaid Table; (ii) the same shall not be sold or otherwise disposed of in any manner for a period of at least two years from the date of importation; and (iii) in the event of his failure to comply with the said conditions, he shall be liable to pay an amount equal to the difference between the duty payable on the said imported goods but for the exemption contained herein and that already paid at the time of importation, if any : TABLE S.
