Amendment to Notification No. 161/92-Cus. - G.E. No. 188B - 06/94 - Customs -TariffExtract Amendment to Notification No. 161/92-Cus. - G.E. No. 188B Notification No. 6/94-Cus. Dated 8-2-1994 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962) the Central Government being satisfied that it is necessary in the public interest so to do, hereby makes the following amendments in the notification of the Government of India in the Ministry of Finance Department of Revenue, No. 161/92-Customs, dated the 20th April, 1992, namely :- In the said notification, - (i) for condition (i) the following shall be substituted, namely :- "(i) the components are imported under, and in accordance with a licence or a release order (hereinafter referred to as the said licence) granted by the Licensing authority, in terms of sub-paragraph of paragraph 46 of the Export and Import Policy" (ii) In the Explanation, - (1) for clause (i), the following clause shall be substituted, namely :- `(i) "capital goods" means any plant, machinery, equipment or accessories required for, - (a) manufacture or production of goods and includes packaging machinery and equipments, refractories, refrigeration equipments, power generating sets, machine tools, equipments and instruments for testing research and development, quality and pollution control; (b) use in mining, agriculture, acquaculture, animal husbandry, floriculture, horticulture, pisciculture, poultry and sericulture.' (2) in clause (ii), the words "as amended from time to time" shall be inserted at the end; (3) for clause (iii) the following clause shall be substituted, namely :- `(iii) "Licensing authority" means an authority competent to grant a licence under the Import (Control) Order, 1955, made under the Imports and Exports (Control) Act, 1947 (18 of 1947) or the Director General of Foreign Trade appointed under section 6 of the Foreign Trade (Development and Regulation) Act, 1992 (22 of 1992) or an officer authorised by him to grant a licence under the said Act.'
