Amendment to Notification No. 75/85-Cus. [G.E. No. 83] - 281/88 - Customs -TariffExtract Amendment to Notification No. 75/85-Cus. [G.E. No. 83] Notification No. 281/88-Cus. Dated 30-9-1988 In exercise of the powers conferred by sub-section (1) of Section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 75/85-Customs, dated the 17th March, 1985, namely :- In the said notification, after paragraph 2, for the Explanation, the following Explanation shall be substituted, namely,- " Explanation : For the purposes of this notification, "fuel efficient motor vehicle" means, (i) in the case of a petrol driven motor vehicle of engine capacity not exceeding 1000 cubic centimetres (excluding motor cars, three-wheeled motor vehicles and two-wheeled motor vehicles), a motor vehicle which runs not less than 19 kilometres per litre of petrol; and (ii) in the case of diesel driven commercial motor vehicle, a motor vehicle which satisfies the specific fuel consumption and kilometres moved or net-tonne Kilometres moved per litre of diesel as specified in columns (3) and (4) of the Table II hereto annexed, with further upgradation of kilometres or net-tonne kilometres norms from the date from which such upgraded norms shall be applicable, as specified in column (5) of the said Table, and certified accordingly by an officer not below the rank of Deputy Secretary to the Government of India in the Ministry of Industry, Department of Industrial Development, on the basis of the tests (hereinafter referred to as Fuel Efficiency Test) carried out by the Vehicle Research Development Establishment of the Ministry of Defence, Ahmednagar, (Maharashtra) or the Automotive Research Association of India, Pune (Maharashtra) having regard to the following, namely :- (A) in the case of a petrol driven motor vehicle engine capacity not exceeding 1000 cubic centimetre the fuel efficiency test shall be conducted with a pay load of 500 kilograms using petrol having an octane level not exceeding 87 at a steady speed of 50 kilometres per hour, (B) in the case of a diesel driven commercial motor vehicle, (a) the fuel efficiency test shall be conducted with the maximum authorised pay load determined in accordance with IS:9211-1979; and (b) the vehicle shall be tested with cab and body as follows :— (i) where the vehicle is having production of cab and body as standard fitment, the same shall be used; (ii) where the vehicle is not having standard production of cab; or (iii) where the vehicle is not having standard production of body or is having more than one version of standard production of body, the following allowances shall apply, namely, - GVW Range Body Wt. Cab Weight (i) 6000 kgs and above but below 10,000 kgs 700 kgs 400 kgs (ii) 10,000 kgs and above 1000 kgs 400 kgs (c) the fuel efficiency test shall be conducted using diesel having cetane level of 42; (d) the fuel efficiency tests shall be carried out at a steady speed of 40 and 60 kilometres per hour as specified in the Table-II, annexed; (e) the specific fuel consumption shall be taken as the minimum value at full load and full throttle in accordance with the testing conditions stipulated in IS : 10000 (Part VIII) - 1980; and (C) the fuel efficiency tests shall be carried out on as elected level of test track for a minimum stretch of one kilometre and the average of 20 runs, comprising 10 runs in each direction, shall be taken for carrying out tests and the test figures shall be corrected to sea level altitude and to +25 degree Centigrade ambient temperature; (D) detailed fuel efficiency testing procedures shall be as specified by the Ministry of Industry (Department of Industrial Development).".
