Dated 1-8-1988 In exercise of the powers conferred by sub-section (1) of Section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts machinery, equipment, instruments, components, spares, raw-materials and consumables required for the purposes of the Light Combat Aircraft Programme of the Ministry of Defence (hereinafter referred to as the LCA Programme goods), when imported into India by an Authorised Work Centre therefor specified in the Table below, from - (i) the whole of the duty of customs leviable thereon which is specified in the First Schedule to the Customs Tariff Act, 1975 (51 of 1975); and (ii) the whole of the additional duty leviable thereon under Section 3 of the said Customs Tariff Act : Provided that the Authorised Work Centre produces to the Assistant Collector of Customs at the time of importation, in each case, a list of the LCA Programme goods to be imported, with the relevant description of such goods, - (i) duly certified by the Senior Manager, Aeronautical Development Agency, to the effect, - (a) that the LCA Programme goods mentioned in the list are required for the purposes of the Light Combat Aircraft Programme of the Ministry of Defence, (b) that such goods are not manufactured in India, (c) that the same shall be used only for the purposes of the said Programme; and (ii) duly certified also by an officer not below the rank of a Deputy Secretary to the Government of India, in the Ministry of Defence, to the effect that the import of the LCA Programme goods mentioned in the said list is authorised by the Ministry of Defence under and for the purposes of the Light Combat Aircraft Programme of the Ministry of Defence.
