Amendment to Notification No. 13/81-Cus. [G.E. No. 127] Notification No. 197/88-Cus. Dated 9-6-1988 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendment in the notification of the Government of India in the Ministry of Finance, Department of Revenue, No. 13-Customs/81, dated the 9th February, 1981, namely :- In the said notification, in the first paragraph, after condition No. (8), the following condition No. (9) shall be inserted, namely :- "(9) Notwithstanding anything contained in this notification, the exemption contained herein shall also apply to spares and consumables, other than those specified in the Table below, to the extent of 1.5% of the ex-factory value of manufacture of articles for export out of India by the undertaking during the preceding year or such percentage in excess thereof as the Central Government may in each individual case allow having regard to the recommendations made in this behalf by the said Board of Approvals for Hundred Percent Export Oriented Undertakings for the purpose of supply of such spares and consumables with the export articles for aftersale-service, subject to the condition that such supply is specifically stipulated in the relevant export contract and the Assistant Collector of Customs is satisfied that the values of such spares and consumables have been included for arriving at the value addition as required under the said Import and Export Policy.
