Amendment to 11 Notifications Notification No. 196/88-Cus. Dated 7-6-1988 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government being satisfied that it is necessary in the public interest so to do, hereby directs that each of the notifications of the Government of India in the Ministry of Finance (Department of Revenue), specified in column (2) of the Table hereby annexed, shall be amended or further amended, as the case may be, in the manner specified in the corresponding entry in column (3) of the said Table. THE TABLE S. No. Notification No. and date Amendment (1) (2) (3) 1. 254/84-Customs, dated the 8th October, 1984. In the said notification, in the first paragraph in the Explanation, for clause (d), the following clause shall be substituted, namely :- "(d) the fuel-efficiency test shall be conducted,   - (i) in the case of a model of motor cars for which fuel efficiency certificate has not been issued earlier, on five motor cars; and (ii) in the case of a model of motor cars for which fuel-efficiency certificate has been issued earlier, on two motor cars, elected at random by the testing agency from the production plant and the minimum of the test figures shall be relevant for the purpose of issuing fuel-efficiency certificate.". 2. 74/85-Customs, dated the 17th March, 1985. In the said notification, in the first paragraph, in condition (ii), for the words and brackets "and an officer not below the rank of a Deputy Secretary to the Government of India in the Ministry of Industry (Department of Industrial Development) are", the word "is" shall be substituted. 3. 76/85-Customs, dated the 17th March, 1985. In the said notification, in the first paragraph, - (a) In condition (i), the words and brackets "and an officer not below the rank of a Deputy Secretary to the Government of India in the Ministry of Industry (Department of Heavy Industry)" shall be omitted; (b) in condition (ii), for the brackets and words "(Department of Heavy Industry)", the brackets and words "(Department of Industrial Development)" shall be substituted. 4. 77/85-Customs, dated the 17th March, 1985. In the said notification, in the first paragraph, in condition (ii), for the words and brackets "and an officer not below the rank of a Deputy Secretary to the Government of India in the Ministry of Industry (Department of Industrial Development) are", the word "is" shall be substituted. 5. 78/85-Customs, dated the 17th March, 1985. In the said notification, in the first paragraph, - (a) in condition (i), the words and brackets "and an officer not below the rank of a Deputy Secretary to the Government of India in the Ministry of Industry (Department of Heavy Industry)" shall be omitted; (b) in condition (ii), for the brackets and words "(Department of Heavy Industry)", the brackets and words "(Department of Industrial Development)" shall be substituted. 6. 349/85-Customs, dated the 5th December, 1985. In the said notification, in the first paragraph, in condition (ii), for the words and brackets "and an officer not below the rank of a Deputy Secretary in the Ministry of Industry (Department of Industrial Development) are", the word "is" shall be substituted. 7. 455/86-Customs, dated the 5th November, 1986. In the said notification, in the first paragraph, - (a) in conditions (1) and (2), for the words and brackets "both by an officer not below the rank of an Industrial Adviser or an Additional Industrial Adviser in the Directorate General of Technical Development in the Ministry of Industry and by an officer not below the rank of a Director to the Government of India in the Ministry of Industry (Department of Industrial Development)", the words "by an officer not below the rank of an Industrial Adviser or an Additional Industrial Adviser in the Directorate General of Technical Development in the Ministry of Industry" shall be substituted; (b) in condition (3), for the words and brackets "both by an Industrial Adviser or an Additional Industrial Adviser in the said Directorate General of Technical Development and by an officer not below the rank of a Director to the Government of India in the Ministry of Industry (Department of Industrial Development)", the words "by an officer not below the rank of an Industrial Adviser or an Additional Industrial Adviser in the Directorate General of Technical Development in the Ministry of Industry" shall be substituted. 8. 502/86-Customs, dated the 24th December, 1986. In the said notification, in the first paragraph, in the Explanation, for clause (d), the following clause shall be substituted, namely :- "(d) the fuel-efficiency test shall be conducted,   - (i) in the case of a model of motor cars for which fuel-efficiency certificate has not been issued earlier, on five motor cars; and (ii) in the case of a model of motor cars for which fuel-efficiency certificate has been issued earlier, on two motor cars, selected at random by the testing agency from the production plant and the minimum of the test figures shall be relevant for the purpose of issuing fuel-efficiency certificate.". 9. 503/86-Customs, dated the 24th December, 1986. In the said notification, in the first paragraph, - (a) in condition (ii), for the words and brackets "and an officer not below the rank of a Deputy Secretary in the Ministry of Industry (Department of Industrial Development) are", the word "is" shall be substituted; (b) in the Explanation, for clause (d), the following clause shall be substituted, namely :- "(d) the fuel-efficiency test shall be conducted,   - (i) in the case of a model of motor cars for which fuel efficiency certificate has not been issued earlier, on five motor cars; and (ii) in the case of a model of motor cars for which fuel-efficiency certificate has been issued earlier, on two motor cars, selected at random by the testing agency from the production plant and the minimum of the test figures shall be relevant for the purpose of issuing fuel-efficiency certificate.". 10. 31/88-Customs, dated the 1st March, 1988. In the said notification, in the first paragraph, in the Explanation , after clause (c), the following clause shall be inserted, namely :- "(d) the fuel-efficiency test shall be conducted,   - (i) in the case of a model of motor cars for which fuel-efficiency certificate has not been issued earlier, on five motor cars; and (ii) in the case of a model of motor cars for which fuel-efficiency certificate has been issued earlier, on two motor cars, selected at random by the testing agency from the production plant and the minimum of the test figures shall be relevant for the purpose of issuing fuel-efficiency certificate.". 11. 32/88-Customs, dated the 1st March, 1988. In the said notification, in the first paragraph, in the Explanation , for clause (d), the following clause shall be substituted, namely :- "(d) the fuel-efficiency test shall be conducted,   - (i) in the case of a model of motor cars for which fuel-efficiency certificate has not been issued earlier, on five motor cars; and (ii) in the case of a model of motor cars for which fuel-efficiency certificate has been issued earlier, on two motor cars, selected at random by the testing agency from the production plant and the minimum of the test figures shall be relevant for the purpose of issuing fuel-efficiency certificate.".
