Exemption to filter media for wastewater treatment falling under Heading No. 39.20, 39.21 or 39.26 Notification No. 188/88-Cus. Dated 1-6-1988 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts Filter Media designed for wastewater treatment falling under heading No. 39.20, 39.21 or 39.26 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), when imported into India for use in Wastewater Treatment Plants, from - (a) so much of that portion of the duty of customs leviable thereon which is specified in the said First Schedule, as is in excess of amount calculated at the rate of 40 per cent ad valorem; and (b) the whole of the additional duty leviable thereon under section 3 of the said Customs Tariff Act, subject to the conditions that the importer at the time of importation of the said goods, produces to the Assistant Collector of Customs a certificate issued by an officer not lower in rank than a Deputy Secretary to the Government of India in the Ministry of Energy (Department of Non-Conventional Energy Sources), to the effect that - (i) the said goods are such as are not manufactured in India; and (ii) the said goods are required for use in Wastewater Treatment Plants and are recommended for grant of the above exemption.
