Exemption to specified equipments, spare parts and accessories imported by a Non-Resident Indian Notification. No. 138/88-Cus. Dated 18-4-1988 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts all equipments specified in the Table hereto annexed and spare parts and accessories thereof, (hereinafter referred to as the "said goods"), when imported into India by a Non-Resident Indian, from (a) so much of that portion of the duty of customs leviable thereon which is specified in the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) as is in excess of the amount calculated at the rate of 20% ad valorem ; and (b) the whole of the additional duty of customs leviable thereon under section 3 of the said Customs Tariff Act, subject to the following conditions, namely :- (i) no remittance of foreign exchange is made for meeting the CIF cost of the said goods; (ii) customs duty payable on the said goods shall be paid from the proceeds of foreign exchange remitted into India by the Non-Resident Indian for this purpose; (iii) evidence regarding compliance of conditions (i) and (ii) above is produced to the Assistant Collector of Customs at the time of importation before the concession is allowed; and (iv) the importer produces a certificate from an officer, not lower in rank than a Joint Secretary to the Government of India in the Ministry of Finance, Department of Economic Affairs, to the effect that the importer is a Non-Resident Indian.
