Imported capital goods on export - Procedure Notification No. 322/86-Cus. Dated 15-5-1986 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendment in the notification of the Government of India in the Ministry of Finance, Department of Revenue, No. 13-Customs, dated the 9th February, 1981, namely :— In the said notification, in paragraph 2,— (a) in the opening portion after the words "the Oil and Natural Gas Commission", the words "or the Gas Authority of India Limited, as the case may be," shall be inserted ; (b) in clause (i), for the words "the said undertaking produces a certificate", the words "in the case of the Oil and Natural Gas Commission, the said undertaking produces a certificate" shall be substituted ; (c) after clause (i), the following clause shall be inserted, namely :— "(ia) in the case of the Gas Authority of India Limited, the said undertaking produces a certificate from an officer not below the rank of a Joint Secretary to the Government of India in the Ministry of Petroleum, to the effect that— (a) the articles produced by the said undertaking are required to be supplied against a global tender to Gas Authority of India Limited for a project specified in the certificate, and (b) the goods manufactured and supplied by the undertaking are of a type for the manufacture of which similar production facilities are not available in India except in that undertaking." (d) in clause (ii), after the words "the Oil and Natural Gas Commission", the words "or as the case may be, the Gas Authority of India Limited," shall be inserted.
