Export Promotion Capital Goods (EPCG) Scheme — Amendment to Notification Nos. 111/95-Cus., 28/97-Cus., 29/97-Cus., 49/2000-Cus. and 44/2002-Cus. - 044/2003 - Customs -TariffExtract Export Promotion Capital Goods (EPCG) Scheme — Amendment to Notification Nos. 111/95-Cus., 28/97-Cus., 29/97-Cus., 49/2000-Cus. and 44/2002-Cus. 21 March, 2003 Notification No. 44/2003-Customs In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby directs that each of the notifications of the Government of India in the erstwhile Ministry of Finance (Department of Revenue), specified in column (2) of the Table below shall be further amended, in the manner as specified in the corresponding entry in column (3) of the said Table, namely :- TABLE S. No. Notification No. and Date Amendment (1) (2) (3) 1. 111/95-Customs, dated the 5th June, 1995 In the said notification, in paragraph 2, in condition (8), for the proviso, the following provisos shall be substituted, namely :- "Provided that in respect of licence holder units affected by the earthquake in the State of Gujarat in the month of January 2001, the Licensing Authority may grant extension in the overall period of export obligation up to one more year : Provided further that in case of a licence holder unit referred to in the first proviso, having overall export obligation period of 13 years and in case of other licence having export obligation period of 12 years, extension of overall period of export obligation shall not be allowed."; 2. 28/97-Customs, dated the 1st April, 1997 In the said notification, in the opening paragraph, in condition (6), for the proviso, the following provisos shall be substituted, namely :- "Provided that in respect of licence holder units affected by the earthquake in the State of Gujarat in the month of January 2001, the Licensing Authority may grant extension in the overall period of export obligation up to one more year : Provided further that in case of a licence holder unit referred to in the first proviso, having overall export obligation period of 13 years and in case of other licence having export obligation period of 12 years, extension of overall period of export obligation shall not be allowed."; 3. 29/97-Customs, dated the 1st April, 1997 In the said notification, in paragraph 2, in condition (7), for the proviso, the following provisos shall be substituted, namely :- "Provided that in respect of licence holder units affected by the earthquake in the State of Gujarat in the month of January 2001, the Licensing Authority may grant extension in the overall period of export obligation up to one more year : Provided further that in case of a licence holder unit referred to in the first proviso, having overall export obligation period of 13 years and in case of other licence having export obligation period of 12 years, extension of overall period of export obligation shall not be allowed."; 4. 49/2000-Customs, dated the 27th April, 2000 In the said notification, in paragraph 2, in condition (6), for the proviso, the following provisos shall be substituted , namely :- "Provided that in respect of licence holder units affected by the earthquake in the State of Gujarat in the month of January 2001, the Licensing Authority may grant extension in the overall period of export obligation up to one more year : Provided further that in case of a licence holder unit referred to in the first proviso, having overall export obligation period of 13 years and in case of other licence having export obligation period of 12 years, extension of overall period of export obligation shall not be allowed."; 5. 44/2002-Customs, dated the 19th April, 2002 In the said notification, in paragraph 2, in condition (5), for the proviso, the following provisos shall be susbstituted, namely :- "Provided that in respect of licence holder units affected by the earthquake in the State of Gujarat in the month of January 2001, the Licensing Authority may grant extension in the overall period of export obligation up to one more year : Provided further that in case of a licence holder unit referred to in the first proviso, having overall export obligation period of 13 years and in case of other licence having export obligation period of 12 years, extension of overall period of export obligation shall not be allowed." ; [Notification No. 44/2003-Cus., dated 21-3-2003]
