We are manufacturer of Sponge Iron for which Iron Ore and Iron Ore Pellets are used as principal raw materials. The Iron Ore transported through Railway cum coastal shipping. As per addendum 17 dt. 23.03.2016 issued to Rate Circular No. 36 of 2009 issued by Railway Board in respect of Iron Ore traffic booked through rail cum coastal shipping for domestic consumption in Iron and steel manufacturing units (including integrated Steel plants and mini steel plant etc.) has to submit, a monthly certificate from Excise Department in original providing quantity of Iron Ore used at the manufacturing unit. Iron Ore is excavated product and no Excise duty is payable. There is no record such receipt /consumption /stock of Iron Ore is on record of Central Excise, as ER-6 (Monthly Excise Return for Principal Raw materials) is discontinued from 01.04.2016, as per the Notification No. 8 of 2016 - Central Excise (N.T.) dt. 01.03.2016 We require a certificate duly signed by the Excise authority for procurement of main raw material which is our business requirement at the same time there is no provision in Excise to issue such certificate. In view of the above kindly guide us whether we have to take-up the matter with Railway board authority or we may get certificate from Excise also, if we make representation to the Principal Commissioner. Sir, in absence of such details it is logical to understand that on what basis the department shall issue you the required Certificate. However you may approach if you have got any record in your accouting system about the receipt of such item based on which you may get your need fulfilled. I also welcome views of experts in this regard. Thanks.
Sir, please submit request letter to concern AC/DC for certificate, if there is no such provision obtain the letter from dept that" there is no such provision in excise rules to issue such certificate, so this office is not consider your request against your request letter dated________( your request letter date) " same has to submitted to concern dept along with copy of your request letter which you had submitted to AC/DC..
