On these grounds they levied a redemption fine of Rs. 10,000/- and also a duty of Rs. 1,74,177/-. Thereafter by paying the said amounts the petitioners cleared the said goods. Regarding all these facts there is no dispute. The only dispute is with regard to the fact that whether the scalp vein sets are Intravenous Canulae and Tubing for long term use or not and also as such the same is exempted from duty or not. In the facts and circumstances of this case, such a contention of the petitioners herein has every force in it. 8. Further it is also stated by the petitioner that the Tribunal CEGAT itself in the judgment reported in 1988 (37) E.L.T. 58 has clearly held that Scalp Vein Sets are Intravenous Canulae and Tubing for Long Term Use and will fall under S. No. 21 of List 2 of Appendix 6 of AM 85-88.
