The award passed by the arbitrator is binding on the parties to the agreement unless it is challenged before the Court. The award can be challenged under Section 34 of the Act. The nonpayment of stamp duty under the Stamp Act would make the substantive contract inadmissible as evidence. However such a defect was curable and would no longer exist if the stamp duty was paid.
