NCLAT: NCLT can't evict rent control tenants, lacks jurisdiction.

The National Company Law Appellate Tribunal (NCLAT) determined that the National Company Law Tribunal (NCLT) does not have the authority to evict tenants protected under rent control laws. The Insolvency and Bankruptcy Code (IBC) does not supersede tenancy rights established by the Rent Control Act. The NCLT's jurisdiction is limited to issues directly related to insolvency proceedings. Consequently, the appeal against the NCLT's eviction order was upheld, as evicting a tenant with statutory protection exceeds the NCLT's powers under the IBC. .....
