The appeal was allowed as the Assistant Collector's order was found to be in violation of Section 124 for not giving the party a reasonable opportunity for personal hearing. The orders passed by the Appellate Collector and Assistant Collector were set aside, and the matter was remanded to the Assistant Collector for fresh adjudication with a directive to ensure a hearing within three months.
