Cause of Death of Hamza: The learned trial Judge found that Hamza was shot dead at Poinachi while returning from Mangalore on the night of 29.4.1989. The police, after receiving a telephonic message, found Hamza riddled with bullets and lying bleeding in the driver's seat of a Maruti car. He was declared dead upon arrival at the Government hospital at Kasargod. 2. Responsibility of the Accused for Hamza's Death: The learned trial Judge scrutinized the evidence of PWs 7, 11, 44, and 76, corroborated by PWs 16 and 53, and concluded that the prosecution successfully established that the gold seized belonged to A-1. The evidence indicated that A-3, A-4, and A-5 had active roles in the incident. 3. Existence of a Criminal Conspiracy to Murder Hamza: The trial Judge found that the prosecution established a conspiracy to murder Hamza involving A-3, A-4, A-5, A-7, A-9, and A-15.
