Issues:

Analysis:

Issue 1:
The appeal was filed by the revenue under Section 260A of the Income Tax Act, 1961 against the order of the Income Tax Appellate Tribunal, Delhi Bench regarding the deduction under section 80HHC on the face value of DEPB. The substantial question of law raised was whether the ITAT was justified in allowing the deduction when the turnover exceeds Rs.10 crores, considering the amendments made by the taxation Law (Amendment) Act, 2005 with retrospective effect from 01.04.1998. ITO, despite the reversal of the decision by the Hon'ble Bombay High Court in the case of CIT Vs. Kalpataru Colours and Chemical. The Court, based on the previous orders and the judgment of the Bombay High Court, disposed of the appeal without issuing a notice to the respondent, granting them the liberty to move the Court if they had any grievances against the order.
