As long as the assessee fulfilled the conditions, including applying for approval before the deadline, the deduction should be permitted. The Court emphasized that the approval, if granted, would be retroactive to the application date, and the failure to obtain approval before assessment completion did not invalidate the claim for deduction.

In conclusion, the High Court ruled in favor of the assessee, upholding the decision of the Tribunal and confirming that the provision for gratuity was an allowable deduction for the assessment year 1976-77.
