1989 (8) TMI 42 - HC - Wealth-tax

The High Court of Gauhati ruled that two idols, Sri Radha and Sri Krishna, are to be assessed separately for wealth tax purposes. The idols were endowed by Baikuntha Gupta in pre-partition days and are located in Cachar District of Assam. The court held that idols are considered persons and individuals under the law. The Wealth-tax Act applies to deities, and the assessment made on the trustees for the idols was deemed sustainable. The court ruled in favor of the Revenue and against the assessee.
