2015 (2) TMI 373 - HC - Indian LawsNon disposal of appeal - Held that - matter was listed on several days but the Tribunal has not taken up those appeals. The fact remains that the appeals are still pending and has not been disposed of by the CESTAT. The Judicial Member of the CESTAT is directed to file affidavit disclosing the reasons why the aforesaid appeals have not been disposed of within the time frame indicated in the order dated 29th January, 2014. Such affidavit shall be filed within a week from the date of communication of this order.
The High Court of Calcutta directed the Judicial Member of CESTAT to file an affidavit explaining the delay in disposing of appeals as per the order dated January 29, 2014. The matter is scheduled to appear again in two weeks. (Case Citation: 2015 (2) TMI 373 - Calcutta High Court)
