2016 (2) TMI 1251 - SC - Indian Laws

Issues:
Election to Managing Committee of J. S. Hindu Inter College, Amroha, Uttar Pradesh

Analysis:
The Supreme Court of India, comprising Mr. Kurian Joseph and Mr. Rohinton Fali Nariman, JJ., addressed the issue of election to the Managing Committee of J. S. Hindu Inter College, Amroha, Uttar Pradesh. The Court noted that the disputed term had already expired, rendering a detailed examination of the facts unnecessary. The appellant's counsel highlighted the absence of fresh elections despite the term's expiration, while the State's counsel pointed out that the Director of Education is responsible for overseeing the election process. In response, the Court issued a directive for the Director of Education, Government of U.P., to personally supervise the elections to the Managing Committee of the college, including the preparation of electoral rolls. The Court mandated the conclusion of the electoral process within six months, emphasizing expeditious proceedings. Consequently, the impugned judgment was modified accordingly. The civil appeals were disposed of without any order as to costs.

In conclusion, the Supreme Court granted leave and disposed of the civil appeals concerning the election issue at J. S. Hindu Inter College, Amroha, Uttar Pradesh, in accordance with the non-reportable judgment. Additionally, any pending interlocutory applications were also disposed of by the Court.
