3. However, the appeal was dismissed due to the low tax effect, as per Circular No.17/2019 issued by the Central Board of Direct Taxes. The appellant's submission regarding the tax effect being below the threshold limit of ?1 Crore led to the dismissal of the appeal. The Court left the substantial questions of law open, providing the Revenue with the liberty to seek restoration of the appeal for hearing on merits if the tax effect exceeded the prescribed threshold. No costs were awarded in this dismissal based on the tax effect criterion.
